MINUTES FOR REGULAR COMMISSION MEETING HELD MAY 14, 2001
BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R. Thayne, Commissioner Larry S. Ross, and Commissioner Lorna Stradinger.

Others Present:  Clerk/Auditor Diane Freston, Road Supervisor Douglas Nielsen, Deputy Clerk/Auditor Carol Casey, Jack & Barbara Burgess.

Road Items - Supervisor Douglas Nielsen
Doug presented five copies of the Cooperative Agreement for the Final Design Engineering Reimbursement of project no. STP-1544(1)5 Arcadia Road for signature.   The agreement calls for a county match of 6.77%.  A check for the partial matching amount of $7,256.20 will need to be sent to the UDOT comptroller's office.   The project is scheduled to begin in October of 2002.

Motion:   Commissioner Ross motioned to accept the Cooperative Agreement for the Final Desig Engineering Reimbursement and to make the requested payment.  Commissioner Stradinger second.  The motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Commissioner Thayne requested that the road department grade the road to Yellowstone Canyon for an activity that is occurring there this weekend.

Koch Road Maintenance - Jack Burgess
Mr. Burgess lives on the Kock Road.  The road leaves Highway 40 at about Mile Marker 72.  Mr. Burgess stated that he recently lost his home to fire.   The response time for the fire department was forty-five minutes and he feels that at least fifteen minutes could have been saved if his road was in better condition.

He also states that three years ago the commission promised him that the road would have some serious repairs made.  He is requesting that the road department do something to make the road wider and also put down some road base to help when it rains.

Doug reminded Mr. Burgess that the last time he came in he complemented the road department on the condition of the Koch Road.  Mr. Burgess answered that at that time it was in better condition than it had been in a long time.  The road is now in bad shape and needs some attention.

Commissioner Thyane agrees that work needs to be done but the problem is the road department has twelve hundred miles of county roads to maintain and limited funds.  Commissioner Ross suggested that Doug have a grader widen the road where they can.

Doug stated that the department will not be able to put any road base on at this time.

Commissioner Stradinger feels that we should have some kind of follow-up with Mr. Burgess this fall to inform him what future improvements can be made.

Final Plat Approval Caroline Estates Phase II - Bob West
Mr. West presented the final plat of Caroline Estates Phase II for review.

Clayton stated the subdivision has Roosevelt City water, and an approval from the health department for septic systems.

Motion:  Commissioner Ross motioned to approve Caroline Estates Phase II.  Motion second by Commissioner Stradinger.  The motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Forest Service Law Enforcement Agreement #01-LE-10040100-004   Travis Mitchell from the sheriff's office presented the Cooperative Law Enforcement Agreement for 2000/2001, and the Financial and Operating Plan Exhibit A for 2000/2001.

Motion:  Commissioner Ross motioned to adopt and sign the law enforcement agreement.  Motion second by Commissioner Stradinger.   Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Motion:  Commissioner Ross motiond to agree to the financial and opearting plan exhibit A between Duchesne County Sheriff's Office and Ashley National Forest.  Motion second by Commissioner Stradinger.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Duchesne County Water Conservancy District - Official Name as per State Law  The subject was discussed and will be on next week's agenda (May 21st, 2001) as a resolution.

GM Class Action Settlement Discussion - Lee Woods
Lee informed the commission of a class action settlement covering owners of 1973-1986 C and K series and 1987-1991 R and V series Chevrolet and GMC trucks.   These pickups have side mounted gas tanks.  The gas tanks could explode on side impact.

The owners of these trucks may receive a settlement certificate for $1,000.00 toward the best price negotiable for an eligible vehicle or collect $100.00 cash alternative.

Attorney Uresk informed the commission that these vehicles do have a lower value because of the court findings.

The commission discussed the cost of fixing the trucks or offering them for sale.

Motion:  Commissioner Stradinger motioned to inform the new owners of any of the eligible trucks we have sold regarding the class action settlement.  Motion second by Commissioner Ross.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Motion:  Commissioner Ross motioned to take the $100.00 cash alternative on those vehicles still owned by the county.  The money to be used for insurance premiums on these trucks.  Motion carried.  Roll Call Vote:  Two Commissioners Voting Aye.  Commissioner Stradinger abstained.

Commissioner Stradinger feels that the money should be used to fix the gas tanks.  She is concerned that an accident could happen with on of the trucks and hold the county liable.

Motion:  Commissioner Stradinger motioned to take the $100.00 cash alternative.  Then evaluate those trucks which may need their tanks fixed.  A decision will be made then as to what repairs will be done.   Commissioner Ross second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Resolution #01-05 A Resolution Re-aligning Voting Precinct #2 and Creating Voting Precinct #6 - Lee Woods

Lee informed the commission that Voting Precinct #2 in Roosevelt had reached the maximum of 1000 voters.

RESOLUTION NO. 01-05
A RESOLUTION RE-ALIGNING THE BOUNDARY LINES OF DUCHESNE COUNTY ELECTION PRECINCT, ROOSEVELT NO. 2 AND CREATING A NEW VOTING PRECINCT, ROOSEVELT NO. 6

WHEREAS Duchesne County Election Precinct Roosevelt Number 2 has exceeded the number of voters per precinct as the guideline in defining the election precinct, and;

WHEREAS the numbers of voters in excess of the guideline is such that a new precinct is justified, and;

WHEREAS the Duchesne County Board of County Commissioners deems it to be in the best interest ofthe voters and the County to create a new Election District out of the existing Roosevelt Election District No. 2 and refer to said district as Roosevelt Election District No. 6,

BE IT THEREFORE RESOLVED by the Board of County Commissioners for Duchesne County that:

  1. A new election district referred to as Roosevelt Election District No. 6 is hereby created with the following boundaires:  to wit:  Beginning at the Northwest corner of the intersection of 200 South and State Street, thence North along the West side of State Street to the Southwest corner of the intersectino of State Street and 200 North; thence West along the South side of 200 North to the Southeast corner of the intersectiion of 200 North and 7000 West; thence South along the East side of 7000 West 1980 feet; thence due East along an imaginary line through Sections 21, 22, 23, 24 of Township 2 South Range 1 West; to the Northwest corner of the intersection of 200 South and State and the point of beginning.

  2. The boundaires of the old Duchesne Election Preceint Roosevelt No. 2 shall be dfined as follows:  Beginning at the Northwest corner of the intersectino fo 200 North and Highway 121 (Neola Highway); thence Northwest to the South side of 4000 North; thence West to the East side of 3000 West (Cove Road); thence South along siad road to the South side of Bluebell Road; thence West along Bluebell Road to the East side of 7000 West; thence South to the upper quarter of Section 21, Township 2 South Range 2 West; thence due East along an imaginary line through Sections 21, 22, 23, 24, and continuing due East through Sections 19, 20, 21 of Township 2 South Range 1 West to the Northwest corner ofthe intersectino fo 200 South and State Street; thence North along the East side of State Street to the Southwest corner of 200 North and State Street; thence West along the South side of 200 North to the intersectino fo 200 North and Highway 121 and the point of beginning.

  3. This new Rosoevelt Election District No. 6 and the realignment of Roosevelt Election District No. 2 shall be effective immediately upon the signing by the signing of this resolution by the Board of County Commissioners of Duchesne County and its publications.

Motion:  Commissioner Stradinger motioned to approve Resolution #01-05.  Commissioner Ross second.  Motion carried. Roll Call Vote:  All Commissioners Voting Aye.

Resolution #01-06 Updating Policy and Procedures Manual Section 5 and Section 7.  Motion: Commissioner Ross motioned to approve the changes to section 5 and section 7 allowing the transfer of an employee from one department to another, and advertising in house for seven days then publicly for two weeks when an opening within the county occurs.  (This resolution is on file in the Clerk's Office)

Motion:  Commissioner Ross motioned to accept Resolution #01-06.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Minutes:  The Commission Minutes for May 7, 2001 were reviewed and corrections made.

Motion:  Commissioner Ross motioned to approve the minutes with corrections.  Commissioner Stradinger second.  The motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Timesheets:  Leann Steart, Deputy Clerk-Auditor presented the commissioners with department head timesheets for their signatures.

Motion:  Commissioner Stradinger motioned to approve the vouchers.  Commissioner Ross second.  The motion carried.  Roll Call Vote:  All Commissioners Voting Aye.
