MINUTES FOR REGULAR COMMISSION MEETING HELD APRIL 30, 2001 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R. Thayne, Commissioner Larry S. Ross, and Commissioner Lorna Stradinger.

Others Present:  Clerk/Auditor Diane Freston, Road Supervisor Douglas Nielsen, Deputy Clerk/Auditor Carol Casey, Beverly Park, Regina Barnhurst, Dan Peatross, Russ Hillman, Lucile & Jessup VanTassell, Steve Sweat.

Minutes:   The Commission Minutes for April 23, 2001 were reviewed and corrections made.

Motion:   Commissioner Stradinger motioned to approve the minutes with corrections.   Commissioner Ross second.  The motion carried.  Roll Call Vote:  All Commissioner Voting Aye.

Road Items - Supervisor Douglas Nielsen
Doug reported on his meeting in St. George.  Mr. George Thompson the UDOT projects coordinator presented to the joint highway committee the Duchesne County request for funding for the Lakefork Bridge replacement on county road 251, and the rehabilitation of the Bridgeland Bridge.  Mr. Thompson fel tif both bridges were in the same project we would get a better bid with one contractor.  The request will go on a STIP.

Commissioner Ross would like to have a public meeting to inform the community the intent for the Bridgelane Bridge as soon as the STIP is awarded.

Doug discussed a letter he received from Greg Searle of UDOT.  According to the Cooperative Agreement Modification No. 2, the county needs to pay $8,718.69 to UDOT Project #BRO-LC13(2) which is our 20% share.  This amount can be deducted from the right-of-way payments the county has made.  It is Dougs understanding that the $63,740.00 right-of-way money should have been reimbursed to the county.  Mr. Searle says a check was issued to the county in December 2000.  Auditor Freston will research the item.  Doug requested that a check for $8,718.69 be issued on the assumption that it has been paid.

Commissioner Stradinger resonded that she is opposed to paying anything until she receives proof we have the $63,740.00 reimbursement.

Motion:   Commissioner Ross motioned that upon confirmation that we have received the $63,740.00 reimbursement from UDOT the $8,718.69 payment may be sent.  Motion second by Commissioner Stradinger.  Motion carried. Roll Call Vote:   All Commissioners Voting Aye.

Commissioner Thayne and Doug discussed the Ioka Cemetery Road being a county road.  There is a problem with the cemetery gate being locked.  Doug will check into the complaint.

Commissioner Thayne stated Jim Brown reported to him that the county is grading BLM roads in the Nine Mile area.  Doug will take a county  map and review the roads in that area.

Ordinance No. 01-179 - Zone Change - Joseph Kemp requesting zone change from AR-1 Agricultural Recreational five-acre zone to RR Rural Residential a one-acre zone, located in the Talmage area.

Dan Peatross is represented Mr. Kemp for the zone change.  He stated that Mr. Kemp would like to deed a one-acre parcel to a family member.

Teresa Nielsen stated that the planning commission did review the request.  One member of the planning commission opposed the request because the planning commission approved the zone change subject to survey completion.

Motion:   Commissioner Stradinger motioned to approve Ordinance #01-179.  Commissioner Ross second.  The motion carried.  Roll Call Vote:   All Commissioners Voting Aye.

ORDINANCE NO. 01-179
AN ORDINANCE CHANGING THE ZONING FROM A/R-1 (AGRICULTURAL/RECREATIONAL), A 5-ACRE ZONE, TO RR (RURAL RESIDENTIAL), A 1-ACRE ZONE

WHEREAS Duchesne County has adopted a zoning ordinance, zoning portions of the county for various uses, and

WHEREAS a property owner has petitioned the county to change the zoning for use from A/R-1 (Agricultural/Recreational), a 5-acre zone, to RR (Rural Residential), a 1-acre zone on a parcel of property located in Section 25, Township 1 South, Range 5 West, USM., and

WHEREAS the matter has been brought before the Duchesne County Planning and Zoning Commission, and

WHEREAS the Planning and Zoning Commission has held a public hearing on said zone-change request and after due consideration recommends that the zone change be granted and

WHEREAS the Duchesne County Commisison has had a full discussion of the matter in a public meeting, and

BE IT HEREBY ORDAINED as follows:
The current zoning of A/R-1 (Agricultural/Recreational), a 5-acre zone, is changed to RR (Rural Residential), a 1-acre zone for the following parcel of property described as follows:

Township 1 South Range 5 West U.S.M.
Section 25.  Beginning at the Northeast corner of said section; thence South along the section line 250.00 feet to a nail and washer at the easterly etension of a fence; thence West along said fence 174.00 feet to an iron rod; thence North 250.00 feet to a nail and washer on the North line of said section; thence East 174.00 feet along the North line of said section to the point of beginning.  Contains 1.00 acres more or less.  Basis for bearings being South along the East line of Section 25.

Motion:   Commissioner Ross motioned to approve the tax adjustments.  Commissioner Stradinger second.  The motion carried.  Roll Call Vote:   All Commissioners Voting Aye.

Commissioner Thayne made the comment that he found it interesting that every time the commission makes a decision to say no the State Tax Commission says yes and if we say yes the State Tax Commission says no.

Zone Change - Jessup VanTassell requested a zone change from AR-1 Agreicultural Recreational 5-acre zone to a RR Rural Residential one-care zone, located in the Tabiona area.

Mr. VanTassell explained to the commission that he would like to do some construction and remodeling on the old house.  Water and sewer is available.  Teresa reported that the planning commisison has given a favorable recommendation.

Motion:   Commissioner Stradinger motioned to approve Ordinance #01-178.  Commissioner Ross second.  The motion carried.  Roll Call Vote:   All Commissioners Voting Aye.

Section 5:  Beginning at an existing yard fence corner, said corner being West 234.52 feet and South 399.80 feet from the North Quarter corner of said section as monumented by a 1/2 "rebar"; Thence North 59*02'35" East 272.97 feet along said yard fence and extension thereof, through an existing building to the East line of the NE1/4 of the nW1/2 of said section 5; Thence South 0*05'43" West 390.17 feet along said East line to the North right-of-way line of the Coutny Road; thence North 43*03'57" West 341.83 feet more or less along said right-of-way line to the point of beginning.  Containing 1.05 acre.

Auditor's Office - Vouchers - Department Head Time Sheets - Tax Adjustments - Personnel Issues

Timesheets:   Leann Stewart, Deputy Clerk/Auditor presented the commissioners with department head timesheets for their signatures.

Vouchers:   Diane Freston, Clerk/Auditor, presented vouchers #73055 to #73114 totaling $262,993.05 for approval.

Motion:   Commissioner Stradinger motioned to approve the vouchers.  Commissioner Ross second.  The motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Personnel Issues:  Judy Mutton
The commission denied a request from a former employee for a promissory note for education payments to the county.

Judy presented a draft of changes to Policy & Procedures Manual section 5.3.a - hiring/rehiring and section 7.1.a - transfers, reassignment and promotion.  The commission made several suggestions as to the verbiage.  The draft will be resubmitted next week.
