MINUTES FOR REGULAR COMMISSION MEETING HELD APRIL 23, 2001 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commissioner Chairman Guy R. Thayne, Commissioner Larry S. Ross, Commissioner Lorna Stradinger.

Others Present:  Road Supervisor Douglas Nielsen, Clerk/Auditor Diane Freston, Deputy County Attorney Roland Uresk, Georg Adams, Thomas & Elva Zaragoza, Beverly Park, Regina Barnhurst, Gary & Kaye Robb, Elton & Arva Potter, Roni & Jeffery Potter, Guy Jr. & Janice Taylor, Dorothy Ivie, Verl R Ivie, Kim Peterson, Marc Edminister, and Deputy Clerk Carol Casey.

Minutes:  The Commission Minutes for April 9, 2001 were amended and approved. Commissioner Ross suggested that when the road department paves the cemetery entrance in Altonah to pave the Altamont cemetery road also.

Motion:  Commissioner Ross motioned to approve the minutes with amendments.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Minutes: The Commission Minutes for April 16, 2001 were reviewed and corrections made.

Motion:  Commissioner Stradinger motioned to approve the minutes with corrections.  Commissioner Ross second. Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Road Items – Supervisor Douglas Nielsen
Doug informed the commissioners that the road department will finish their project at USU today.  They will move the crusher from Roosevelt to Altamont to prepare for the paving projects there.

Commissioner Stradinger asked if Doug was able to help the hospital with their graveling needs.   Doug replied that he had talked with Hospital Administrator Brad LeBaron regarding size of rock.  Mr. LeBaron will get back with Doug when he has more information. Doug reminded Mr. LeBaron that after June first the road department would be busy paving county roads and unable to assist the hospital.

Doug will be attending a meeting in St. George with the joint highway committee.  They will discuss the funding for replacement of the Lake Fork Bridge and the rehabilitation of the Bridgeland Bridge.

Commissioner Stradinger stated she was contacted by Mrs. Swensen, a 3rd grade teacher from Price Elementary, requesting we grade the Nine Mile Road in preparation for a bus trip for her students.   

Rock Creek Road Issues – Dorothy Ivie

Mrs. Ivie stated that three years ago she and her neighbors were promised that their road would be improved.  The Rock Creek Road which takes off from State Highway #35, was on the county schedule for improvement and paving.  She has since been on a mission. She expressed her disappointment that having returned she finds no improvements have been made and now the road is in worse condition. She states…

“There are thirteen families living and traveling this road.  This spring the road was so bad that several cars and pickups were mired in the mud.  They even sunk a four-wheel drive to the axels.  The mud has dried now and a grader came in and knocked down the ruts but the road is still very rough.   Fifteen years ago base was put on this road and it helped for a while, but it’s time to make a permanent improvement”.  

 

Doug stated that he had the Army Corp of Engineers inspect the road to see what would need to be done with the ¼ mile of wetlands.  The Corp informed Doug that this stretch was wetlands and in order to widen it they would need to move the road to the east.  Doug stated he got busy with other matters and the project has not progressed from that point.

Johny said they went to Mrs. Ivie’s home and turned around on the road tour. Mrs. Ivie said that there is a hole in the bridge by Potter’s home that needs fixed. There are 14 families who access their homes from this road.

Clayton said that the county requires a 66-foot right-of-way.  This is required so the road department equipment can get into the area without causing damage to the fences.

If this road is considered for improvements the property owner’s will need to relocate their fences back to allow for an adequate right-of-way.

Valonna said if we decide to add this road to our list for oil can Doug go out and show them what needs to be done?

Planning and Zoning minutes of April 1998
Johny stated that this road would need to be done in phases.  We could propose doing the first 1.5 miles of the road which is in good enough shape to do.  The property owners would then need to have the fences moved to allow for the 66-foot right-of-way before the county could consider doing the upper part of the road.

Verl Ivie Jr. said that the previous Road Department Supervisor came up to the property and showed them where the fences needed to go.

Vern stated that the requirements have changed since that time.  Vern recommends that we propose to oil the first 1.5 miles of oil.  Vern explained that the road lists are done years in advance so this probably couldn’t be considered until 1999. We will recommend that the road is maintained in the meantime.

           

Dorothy stated that the county promised to work on the road in stages. The promise was never carried through and she feels that the county should put it back on the list for improvements this year.

Commissioner Stradinger asked Doug if he will have time this year to do the work.  Doug answered that they could get started this fall with some gravel, and this fall redo the road thru the wetlands with a new right-of-way.

Commissioner Thayne asked that Doug use his judgment, haul some gravel into the areas that need it, and make the road useable for the summer.

Commissioner Ross stated that the road should be brought up to county standards with 66 ft. right-of-ways. It will be up to the landowners to do their part by moving their fences back as referenced in the Planning & Zoning minutes.

The commissioners scheduled a road tour with Doug for May 1st, 2001.

Kim Peterson stopped in to request that some work be done on the Sam’s Wash Road west of Duchesne.  The commission stated they would see what could be done.

Tax Issues – Thomas Zaragoza
Mr. Zaragoza has been paying taxes for six years for property that was assessed with a secondary home classification.  He does not have two homes. There was a mistake on the assessment. Mr. Zaragoza would like a refund.

Motion:  Commissioner Ross motioned to refund to Mr. Zaragoza $497.99 in the form of a check.  Commissioner Stradinger second.  Motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

CIB Funding Resolution for Fire Equipment
Mr. Marc Edminister of Lewis Young Robertson and Burningham, a municipal financial consulting firm was present to advise the commission concerning the following resolution.  "A Resolution Approving The Adoption By The Municipal Building Authority Of Duchesne County, Utah Of A Parameters Resolution Authorizing The Issuance Of Not More Than $1,100,000 Taxable Lease Revenue Bonds, Series 2001; As prepared.”  (refer to Clerk's Office)

Motion:   Commissioner Stradinger motioned that the above resolution be passed to authorize the Duchesne County Municipal  Building Authority to the issuance of not more than $1,100,000 taxable lease revenue bonds, series 2001; as prepared. Commissioner Ross second.  Roll Call Vote:  All Commissioners Voting Aye.

Judy Mutton – Personnel Issues  Judy discussed with the commission some guidelines concerning the UAC Mutual Insurance builders risk options.   Mrs. Mutton also presented a request to hire a correction officer for the jail.

Motion: Commissioner Stradinger motioned to accept the request upon receiving a favorable background check. Commissioner Ross second.  Motion carried.  Roll Call Vote:   All Commissioners Voting Aye.

Discussion & Approval of Resolution 01-04 Policy and Procedures Section 10  Judy presented Section 10.2. which discussed a reimbursements for consideration.  The change being considered is from $5.00 to $7.00 for breakfast. The maximum per diem rate for any one-day of travel would change from $25.00 to $27.00. 

Section 10.2.D. If a meal or meals are provided (included) as part of the workshop, seminar, training. etc. then the amount (s) shall be deducted from the total per diem rate.  (refer to Clerk's Office)

Motion:  Commissioner Ross motioned to accept the resolution as written including 10.2.D.  Commissioner Stradinger second.  Roll Call Vote:  Two Commissioners Voting Aye.   Commissioner Thayne Voting Nay.

Interdepartmental Transfers – County Policy Review and Reconsideration  Judy suggested that a policy be written giving an employee the opportunity for transfer to another department under approval of the commission. No decision was made at this time.

Motion:  Commissioner Stradinger motioned that the commission meeting recess for the scheduled Municipal Building Authority public meeting to discuss and adopt  a resolution authorizing the Issuance And Sale Of Not More Than $1,100,000 Aggregate Principal Amount Of Taxable Lease Revenue Bonds, Series 2001 for Fire Equipment and Buildings. Commissioner Ross second.  Roll Call Vote:  All Commissioners Voting Aye.

Motion: Commissioner Stradinger motioned to go back into commission meeting.  Commissioner Ross second.  Motion carried.  Roll Call Vote:   All Commissioners Voting Aye.

Auditor=s Office - Vouchers -   Tax Adjustments – Personnel Issues  Vouchers:   Diane Freston, Clerk/Auditor, presented vouchers #72989 to #73054 totaling $106,333.79 for approval.

Motion:  Commissioner Ross motioned to approve the vouchers. Commissioner Stradinger second.  The motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Tax Adjustments  There were no tax adjustments at this time.
