MINUTES FOR REGULAR COMMISSION MEETING HELD APRIL 16, 2001 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R. Thayne, Commissioner Lorna Stradinger.  Commissioner Ross absent.

Others Present:  Deputy County Attorney Roland Uresk, Deputy Clerk/Auditor Carol Casey, Road Supervisor Douglas Nielsen, Georgene Scott, Gloria Fasselin, Kaylene Jensen, Mike Casper, Darreld Casper, Beverly Park, Teresa Baker.

Minutes:  The Commission Minutes for April 9, 2001 were reviewed and approval will be tabled until next week in commission meeting.

Road ItemsSupervisor Douglas Nielsen
Doug presented the Cooperative Agreement Modification No.2 for signature.  This modification will remove $27,000 from the low bid by Flare Construction.  The money will be awarded to Horrocks Engineers for construction engineering survey work.

Motion:  Commissioner Stradinger motioned to accept Contract Modification No.2. Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Doug also submitted Payment Request No.1 for construction engineering services through March 31, 2001 from Horrocks Engineers.

Motion:  Commissioner Stradinger motioned to approve Payment Request No. 1 in the amount of $27,510.92 for engineering services through March 31, 2001 on Strawberry Bridges 4,5,6,& 7.  Motion carried.  Roll Call Vote: Both Commissioners Voting Aye.

Commissioner Stradinger stated that a Mr. Kim Peterson had contacted her regarding the road in Sams Wash which is near mile marker 71 and Highway 40.  Kim asked if the county intended to do any more work on this road.  Doug replied that the department had graded the road this spring and by the time the department finishes the roads in Pinion Ridge it will be time to start the road oiling projects outlined for this summer. Commissioner Stradinger feels that if Doug could find time to run the grader over his road once more it would be beneficial.  Doug stated that he will give Mr. Peterson a call.

Asphalt Chipping Oil Bid Opening  There were two bids for chipping oil received.

$167.00/Price-Ton   $18.00/Freight-ton
Totaling:  $185.00/ton
$143.00/Price-Ton   $23.60/Freight-ton
Totaling:  $166.60/ton

Motion:  Commissioner Stradinger motioned to accept the bid from Koch Performance Asphalt Company for $143.00 for HFE 90 chipping emulsion and freight charge of $23.60 per ton within a twenty mile radius of Altamont totaling $166.60.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye

Doug stated that Inland Oil is doing a clean-up of road-ways on Nine Mile and Upper Pleasant Valley Road. They will pick up the garbage and would like the county to provide a dump truck and pickup to haul it to the landfill.

Because of the bad weather last week the Commission Stradinger suggested that the spring cleanup free dumping be extended until Saturday 21, 2001.

Commissioner Thayne feels that next year the county should consider setting dates for free dumping back to later in the spring.

Motion:  Commissioner Stradinger motioned that the free dumping days at the county landfill be extended until Saturday 21, 2001. Motion carried. Roll Call Vote:  Both Commissioners Voting Aye.

Bluebell Road Rights-of-Way Issues – Teresa Baker
Teresa presented a plat map of the rerouted county road in Bluebell showing where the old road is being blocked and other property owners are being denied access.  Teresa believes that this is still a county road and has never been abandoned.  Attorney Uresk stated that a copy of the law concerning the vacating of a street should be sent to the Mr. Terry Alexander.

Nine Mile Canyon Road Issues – Gloria Fasselin
Mrs. Fasselin addressed the commission.  She is frustrated with the condition of the road in the bottom of the canyon.  The dust is extremely bad and it takes fifteen minutes to travel just four miles because of the pot holes.   Doug stated that there is a six-mile strip that is bad.  The summer floods come out of the canyons and run down the center of the road. The road gets a lot of big truck travel which contributes to the dust problem. Doug has checked into the cost of applying magnesium chloride to control the dust.  The cost would be approximately $1763. per mile.  Commissioner Thayne suggested the county try to obtain more right-of-way along this strip to make an area for the water to run off.  The commissioners and Doug decided to personally tour the road on April 20, 2001.

Commissioner Thayne asked if the road going to the Altonah cemetery could be paved? Doug stated that the road department will be paving the main road, and that the quarter mile cemetery road would be no problem.

Zone Change – Mike Casper – Ordinance 01-177
Changing AR 1- Agricultural Recreational  five-acre zone to a RR Rural Residential one-acre zone, Sec 32, T1S, R7W USB&M in the Tabiona area.  (refer to Clerk's Office)

Clayton stated that the planning & zoning board has given their recommendation for the zone change. The water and sewer are available.

Motion:  Commissioner Stradinger motioned to accept the zone change from a AR-1 Agricultural Recreational five-acre zone to a RR Rural Residential one-acre zone.  Motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Dr. Larsen Memorial Fund – John Gale
Mr. Gale is here today to request help for a 61 year old lady with an eye condition.  The woman has stated that unless she can get the necessary surgery she will be blind very shortly.  Her husband is very ill and cannot work.  Deputy Attorney Uresk stated that in the past the memorial fund has been used exclusively for children.

Commissioner Stradinger asked if the woman had any children and if they have been contacted to help their mother.

Mr. Gale answered that the woman informed him they didn’t have the money.

Commissioner Thayne suggested that the woman should first look to her family for funds then the church should be contacted.  Government should be contacted after the other options have failed.

Commissioner Stradinger stated the commission would review the request after the other options have been exhausted.

Auditor=s Office - Vouchers - Department Head Time Sheets – Tax Adjustments – Personnel Issues

Timesheets:   Leann Stewart, Deputy Clerk-Auditor, presented the commissioners with department head timesheets for their signatures.

Vouchers:  Andrea Higbee, Deputy Clerk/Auditor, presented vouchers #72894 to #72988 totaling $400,531.75 for approval.

Motion:  Commissioner Stradinger motioned to approve the vouchers. The motion carried.  Roll Call Vote:  Both Commissioners Voting Aye.

Roy Casper stopped in to discuss his property assessment with the commission. It was decided that the Assessor’s office review the assessment and make a recommendation to the commission at a later date.

The Treasurer’s office submitted a request from a widow who is asking that the county wave interest and penalty on her property taxes.

Motion:  Commissioner Stradinger motioned to wave interest and penalty in the amount of $566.61 for account #002-4178.  Motion carried.   Roll Call Vote: Both Commissioners Voting Aye.
