MINUTES FOR REGULAR COMMISSION MEETING HELD MARCH 19, 2001 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy Thayne, Commissioner Larry S. Ross and Commissioner Lorna Stradinger

Others Present:  Deputy Attorney Roland Uresk, Road Supervisor Douglas Nielsen, Clerk/Auditor Diane Freston, John Swasey, Lavon & Diane Cramer, Brad & Mary Oliver, Pauline Curtain, Shirley Gayler, Jack & Barbara Burgess, Arlene& Phillip Legg, Beverly Park, Regina Barnhurst, Robert Brown, Randy Grimaud, Marty Durham Edie VanZalinge, B.J. Minutes: The Minutes for March 12, 2001 were reviewed and corrections made.  Motion: Commissioner Ross motioned to approve the minutes with corrections. Motion second by Commissioner Thayne. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Road Items - Supervisor Douglas Nielsen
Doug stated that he had not heard from George Thompson from UDOT yet so had nothing to report. Doug also said that there are two roads in Bluebell that need work done on them.

Commissioner Thayne reported that Stan Keller had called him and said that there is a hole near the Lake Fork River Bridge. It cannot be seen by car, but he can see it from the school bus. Mr. Keller also said that from Hwy 40 west through Arcadia there are a lot of pot holes that need repaired.

Commissioner Ross informed Doug of a culvert north of Fred Evans home toward Legrand Gilbert's. The pipe is too short and this is a safety concern. The culvert needs to be extended. The Commissioner also feels that truck use of Summarell Lane should be limited and signs posting no commercial vehicles. Ostler's Corner needs some direction signs and reflectors. Commissioner Stradinger requested that 35-MPH speed signs be placed on the Neola Cemetery Road. In Arcadia, East of Pine Tree Junction, the shoulders of the road are in need of repair.

Report on Pinion Ridge Roads - Roger Grimaud
Mr. Grimaud, spokesperson for a group of citizens from the Pinion Ridge area, reported that the roads in Pinon Ridge are in drastic need of repair. When it snowed this winter and the snow plowing were out the snow banks that were made did not allow for water drainage. Water is puddling in the middle of the road making ruts so deep it takes a four-wheel drive to get through because the water can't drain anywhere.

Supervisor Nielsen agrees that the roads in Pinion Ridge are in need of some work. He had them on his schedule last fall but did not get to them before winter set in.

The Commission and Doug will take a tour tomorrow afternoon to inspect the roads in Pinion Ridge, Vista Valley, and the Koch Field Road. They will pick Mr. Grimaud up at his residence at 1:30 PM.

Jack Burgess asked the commission about the Kock Road. Mr. Nielsen indicated that he is aware of the need and will try to schedule it in. The Road Department ran out of time last fall.

Carport for Senior Apartments - Rose Miller
Canceled because Mrs. Miller was in a car accident last week and could not attend.

Bid Awarding for County Cleaning Supplies
Motion: Commissioner Stradinger motioned to table any decision on cleaning supplies due to the resignation of Neal Potter, and to inform the bidders of their decision. Motion second by Commissioner Ross. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Board Appointments - Library, Duchesne County Water Conservancy, and P/Z County Wide Appointment
Library Board - Motion: Commissioner Ross motioned to appoint to the Library Board the following persons. Sherry Peatross to a three year term ending January 2004 for the Duchesne Area. Larry Henry to a three year term ending January 2004 for the Altamont Area. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Duchesne County Water Conservancy Board  Commissioner Stradinger read aloud the resumes received by the Clerk's office for DCWCD board. (see attachments)  Commissioner Thayne feels that applicant John Swasey is very qualified for this board position. Commissioner Thayne questioned Mr. Swasey regarding some previous problems with the water district and a possible conflict of interest with his currant position as Water Commissioner for Central Utah Water.  Motion: Commissioner Stradinger motioned to appoint John Swasey to a four year term for the Duchesne/Strawberry Division, DCWCD Board. Commissioner Ross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Motion: Commissioner Ross motioned to appoint Brent Walker to a four year term for the Moon Lake Division and Keith Mortensen to the Lake Fork Division for a four year term on the DCWCD Board. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

NOTE - It came to the Commissions attention on March 21st that the board appointments for the DCWCD were done in error. A special commission meeting is scheduled for March 23rd at 8:00 AM to correct the above motion. Those minutes are inserted as follows…..

Meeting held at 8:00 A.M. on March 23, 2001 at the Crossroads Senior Center in Roosevelt.

Special meeting of the commission for the purpose of reviewing and reappointment of Duchesne County Water Conservancy District Board Members.

Present: Commissioner Guy Thayne, Chairman, Commissioner Larry Ross, Commissioner Lorna Stradinger, and Leann Stewart, Deputy Clerk/Auditor taking minutes.

Commissioner Ross stated that because of a misunderstanding of the divisions of the areas for the DCWCD Board that the commission had determined that Lynn Burton=s term was up - which was incorrect so his seat should not be considered at this time. Instead it was Keith Mortensen=s seat that was up.

There were two applicants for the position, Brent Walker and Keith Mortensen. Commissioner Thayne remarked that Keith is a fantastic board member, but Brent should have the opportunity to serve. Commissioner Stradinger felt that Keith should have the opportunity to serve a second term as he has done a good job. Commissioner Ross stated that there were some things going on right now that Keith had a good understanding of.

Commissioner Ross motioned to reappoint Keith Mortensen to a second 4-year term to the Moon Lake Division of the DCWCD. Commissioner Stradinger, second. All commissioners, Aye.

In Monday's commission meeting Mr. John Swasey had been appointed to fill the seat which was open for the Duchesne Strawberry Division of the DCWCD. Now because of some derogatory comments made by Mr. Swasey and an apparent lack of sincerity toward a very important position on the board the commission has chosen to rescind the appointment and appoint someone else.

Commissioner Stradinger motioned to rescind the appointment of John Swasey to the DCWCD and in his stead appoint Kent Peatross to a second 4-year term for the Duchesne/Strawberry Division of the DCWCD. Commissioner Ross, second. All commissioners, Aye.

Planning & Zoning Board 
This item was stricken from the agenda. It will be addressed in next week's Commission meeting.

Auditor's Office - Vouchers - Tax Adjustments - Surplus Sale
Vouchers: Deputy Clerk/Auditor Andrea Higbee presented vouchers #72576 to #72648 and predraws #72574 & 72575 totaling $351,453.86. Mrs. Higbee also asked how the Commissioners wanted to pay Northeastern Counseling. Northeastern is requesting monthly payments. Last year the county made quarterly payments, but prior to that only annual payments were made when taxes were collected. The Commissioners directed her to continue to make quarterly payments.

Motion: Commissioner Stradinger motioned to approve the vouchers as presented. Commissioner Ross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Timesheets: Leann Stewart, Deputy Clerk-Auditor presented the commissioners with department head timesheets for their signatures

Letter Regarding Official Misconduct - Keith Coleman
Mr. Coleman canceled this agenda item.

Attorney Uresk informed the commission that after researching this matter he finds that the commission does not have authority to address malfeasance of office.

Motion: Commissioner Stradinger motioned to strike this issue. Commissioner Ross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.
