MINUTES FOR REGULAR COMMISSION MEETING HELD JANUARY 29, 2001 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commissioner Larry S. Ross (acting as chairman) and Commissioner Lorna Stradinger. Commissioner Thayne was in Salt Lake attending meetings.

Others Present:  Road Supervisor Douglas Nielsen, Clerk/Auditor Diane Freston, Beverly Park, Regina Barnhurst, Olie & Sheila Olsen, Susan & Keith Coleman, Jim Brotherson, Fred Tew, Steve Fink, Clint Robb, Trisha Wright, Michael Brennan, Doug Adams, and Carol Casey.

Minutes: The Commission Minutes for January 22, 2001 were reviewed and corrections made.  Motion: Commissioner Stradinger motioned to approve the minutes with corrections, including additions on page 4 last paragraph, that will be updated by Commissioner Thayne when he returns from his Salt Lake Meeting. Commissioner Ross second. The motion carried. Roll Call Vote: All Commissioner Voting Aye

Road Items: Supervisor Douglas Nielsen
Supervisor Nielsen stated that the road department has been busy pushing snow and with more forecasted for this week they will clean the sanders and prepare for more snow pushing.

Commissioner Stradinger asked Doug why he uses the sand and salt on the roads when the sun seems to be melting the snow? Doug replied that the salt mixture melts the ice and snow at a lower temperature making it possible for the roads to clear off quicker.

Doug advised the Commission that the road department will soon be graveling Road # 146 starting southwest of Neola and running west for 2 miles.

Public Hearing - Zone Change - North Fork Sec 1, 20 acres - Doug Adams   Clayton Chidester presented a request for a zone change from A/R-1 Agricultural Recreational, a 5 acre zone, to a RR Rural Residential a 1-acre zone Section 1, T1N, R9W, USB&M - 20 acres. Located in the North Fork area. Clayton stated the request had been before the Planning & Zoning board, and had met all the requirements and received a favorable recommendation. Mr. Adams has plans to make a subdivision on the land.

Mr. Adams informed the Commissioners that there is a private water source for the subdivision and all the lots have passed their perk tests. Mr. Adams also stated that he did not have any opposition from the neighbors until today. He received one phone call asking questions about lot size.

Commissioner Ross feels the request should not be granted without assurances from Mr. Adams that there is adequate water supply for the subdivision. Mr. Adams stated that the lots will not be sold until the water system is there.

Jim Brotherson asked whose water supply this subdivision will affect and also where. Clayton and Mr. Adams replied that water waste systems will be installed according to the Health Department Standards and that the river is well below the proposed building sites.

Fred Tew asked if the county is setting a precedence that any rural 5-acre lot may be changed to a one-acre building lot as long as there is a water supply. Clayton answered that this is possible if there is water and a favorable sanitation report.

Both Commissioners expressed their concerns regarding this zone change, they feel that there should be sufficient water and sewer before any subdivision is approved. The purpose of the hearing today is to approve the zone change and not the subdivision.

Motion: Commissioner Stradinger motioned to approve the zone change request by Doug Adams Sec 1, T1N, R9W, USB&M - 20 acres contingent upon the State Engineer Office's approval of the water supply. Commissioner Ross second. Motion carried. Roll Call Vote: Both Commissioners Voting Aye.

Auditor's Report - 2000 Budget Year - Diane Freston
Clerk/Auditor Diane Freston presented the department budget reports for the year 2000, stating that all departments are balanced and budget except one. Diane also stated that the financial records had been turned over to the Independent Auditor for the county's annual audit.  (Auditor's Report Attached)

Commissioner Ross asked if the Attorney was aware he is over budget? The Clerk answered that he was, she sends each department a monthly financial report and has spoken to the attorney's secretary.

Commissioner Ross asked that a letter be sent to Attorney Gillespie asking him to define why he is over budget in writing. Commissioner Stradinger offered to write and send the letter to the Attorney.

Motion: Commissioner Stradinger motioned to approve the 2000 budget report. Commissioner Ross second. Motion carried. Roll Call Vote: Both Commissioner Voting Aye.

Keith Coleman asked about the Clerk's authority to dispose of taped minutes. The Commission informed Mr. Coleman that he will need to be on the agenda to discuss this matter.

Mr. Coleman also asked about a statement he read in the UB Standard where the County Attorney requested hiring an additional attorney for his office. The Commission answered that Mr. Gillespie asked for additional help as a budget request but was denied. Mr. Coleman was put on the agenda for the 5th of February to address his concerns and to also give Attorney Gillespie a chance to be present and defend himself.

Steve Fink of Storm Computers, and Clint Robb of Alien Tech approached the Commission with questions regarding the computer bids for computer equipment for the county and the awarding of the bid. The group felt that the process was not done correctly. The commission scheduled a meeting with all concerned in conference room #1 at 11:00 AM on February 5, 2001.

Auditor's Office - Vouchers - Tax Adjustments - Personnel Issues  Personnel Issues: Jamie Park informed the Commission that the road department had requested jackets instead of county shirts and needed approval. The Commissioners felt the request was getting a little out of hand. Commissioner Stradinger wanted to go on record stating that (1) she does not approve of the county providing clothing to the employees and (2) she felt the Duchesne County Taxpayers should not responsible to buy clothing for the county employees. Commissioner Ross stated that he was in favor of the county shirts because it identified county employees to the public and is good for morale. The subject was tabled pending further discussion.

Judy Mutton presented the name of the new employee for the Roosevelt Assessor's office to be approved. The Commission gave their approval.

Motion: Commissioner Stradinger motioned to approve the Tax Adjustments. Commissioner Ross second. The motion carried. Roll Call Vote: All Commissioners Voting Aye.

Vouchers: Diane Freston presented vouchers # 72033 to 72089 totaling $20,765.55 for approval.  Motion: Commissioner Stradinger motioned to approve the vouchers with the exception of Paramount Detective Agency. Commissioner Ross second. Motion carried. Roll Call Vote: Both Commissioners Voting Aye.

Commissioner Ross asked if there were any other matters?

Jim Brotherson and Fred Tew said they were representing the Farm Bureau in thanking the Commissioners for their stand with the State Tax Commission in the property tax issues last fall.

They would also like to remind the Commission of the many sources for Hydro Power in the Basin. Mr. Brotherson feels that with the recent power problems in California now is a good time to consider these clean and free running resources.
