MINUTES FOR REGULAR COMMISSION MEETING HELD JANUARY 22, 2001 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R. Thayne, Commissioner Larry S. Ross, and Commissioner Lorna Stradinger.

Others Present:  Road Supervisor Douglas Nielsen, Clerk/Auditor Diane Freston, Carol Casey, Georg Adams Emergency Management, Deputy County Attorney Roland Uresk, Lloyd Grant, Beverly Park, Regina Barnhurst, Susan Coleman, Roger Holfeltz, and Michael Brennan.

The Commission minutes for January 8th 2001 were reviewed and corrections made.  Motion: Commissioner Ross motioned to approve the minutes with corrections. Commissioner Stradinger second. The motion carried. Roll Call Vote: All Commissioner Aye.

Special Presentation and Recognition -
Commissioner Thayne announced that Georg B.L. Adams, Emergency Management and Fire Director had received the following special recognition as follows.

Dear County Roads

We just wanted to thank you for all the work you are doing on our road. Your employees, who are working here, are courteous and hard working and they are doing an excellent job.

Supervisor Nielsen informed the Commission that the bid opening was held for the final four Strawberry River bridges on January 16, 2001. The bidders were:  Granite Construction Company Inc. -     $1,284,284.00;  W.W. Clyde & Company - $1,240,671.38; Flare Construction, Inc - $1,149,283.50; The apparent low bidder was Flare Construction.

Motion: Commissioner Ross motioned to accept the bid of $1,149,283.50 by Flare Construction, Inc.under UDOT's specifications for Project BRO-LC13(2). The county will be participating 20% on the project. Motion second by Commissioner Stradinger. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

The road department is working on the road by Stewart Pike and Rex Lamb at this time.

Lloyd Grant - Highway 87 Road approx ½ mile of Admin Building  Mr. Grant expressed his concerns regarding Highway 87 as it leaves Duchesne City. The road starts up a 6% grade and narrows down to a two lane road. The traffic has increased on this section of road in the last few years because of…

~The Completion of the Justice Center and Correction Facility
~The New State UDOT Maintenance Shop
~The LDS Stake Center
~The big trucks and semi trucks going to the Landfill
~The County Administration Building
~The Senior Citizen Center
~The School Bus picks up and unloads children on the road
~Several new homes along the road as it ascends to Blue Bench
~Two major turnouts in the city limits and six others all are in the        distance of 0.7 mile.

Mr. Grant feels that a passing lane needs to be provided in the area before someone gets seriously hurt. Mr. Grant stated that he had been to commission meeting in March of 1999 to express his concerns and felt nothing was done and is requesting that a passing lane be provided. He also stated that he had asked the Duchesne City Council to contact UDOT regarding Highway 87, however he feels that the city council would be more interested if the County were to become involved.

Commissioner Stradinger asked if this area is in the city limits? Mr. Grant replied that it has been annexed in.

Commissioner Thayne asked Supervisor Nielsen to contact Mr. Greg Searle to ask if he might have any recommendations.

Motion: Commissioner Ross motioned to send letters to Greg Searle, Alan Mecham UDOT District Engineer, and a copy to Duchesne City encouraging the widening of highway 87 beginning at 800 North to the turn out of the Justice Center and the UDOT shop. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Predator Control Matching Funds
Motion: Commissioner Ross motioned to support the matching funds of $2,000.00 for control of predators (coyotes) in the County. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Service Agreement Between DFW/IDT and Duchesne County- Judy Mutton  Mrs. Mutton presented the service agreement for pre-hire, post accident, and random drug testing. This is an annual contract with DFW/IDT.

Motion: Commissioner Stradinger motioned to accept DFW/IDT contract. Commissioner Ross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Approval of IHC Insurance Contract - Judy Mutton
Mrs. Mutton presented the IHC Medical 2001 Contract and stated that Ray Hussey had given his recommendation for renewal.

Motion: Commissioner Ross motioned to accept IHC's 2001 medical contract. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Voting Procedures and Purchase Policy - Commissioner Stradinger  Commissioner Stradinger ask Deputy County Attorney Uresk for clarification on Roberts Rules of Order for voting procedures. The county adopted the Roberts Rules of Order in 1948 by resolution. Attorney Uresk stated that when there is no second to a motion the chair then may either second or let the motion die for lack of a second. Attorney Uresk suggested that a current edition of the Roberts Rules of order by purchased and be placed in the Clerk/Auditor's office for reference.

Commissioner Stradinger asked for a copy of the county's purchasing policy. She stated that she had been approached by a business supply owner in the county who is interested in bidding for the county office supplies and feels that if at all possible the county should buy locally.

Motion: Commissioner Ross motioned to notice and bid out office supplies. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Agreement Between Utah State University Extension and Duchesne County for Educational Work
Motion: Commissioner Ross motioned to approve the agreement with USU Extension and the County for 2001 for $46,250.00. Commissioner Stradinger second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

Awarding of Computer Bid
The Commission took a final look at the computer bids. Commission Stradinger threw out all bids from outside the Basin. The bids remaining were…

Motion: Commissioner Stradinger motioned to accept Sherrick Computer bid A with the understanding that new systems and peripherals are in the bid, also there will be a good faith agreement with a performance bond. Also a thirty day termination clause in the agreement. There was no second. Commissioner Thayne called for a vote. Roll Call Vote: Commissioner Thayne and Commissioner Stradinger Voting Aye. Commissioner Ross Voting No.

Planning and Zoning Commission Appointment
Commissioner Stradinger requested a second interview with one of the applicants. Commissioner Thayne suggested that since the commission could not agree on an applicant that the position be re-opened with the main political parties becoming involved.

Motion: Commissioner Stradinger motioned to invite the Republican and Democrat Parties in Talmage, Mountain Home and Altamont to submit candidates for the position of Planning and Zoning Commission. Commissioner Ross second. Motion carried. Roll Call Vote: All Commissioners Voting Aye.

UBAOG and Duchesne County Agreement to Administer County Aging Program  Motion: Commissioner Stradinger motioned to approve the 2001 County Aging Contract with UBAOG with corrections. Commissioner Ross second. The motion carried. Roll Call Vote: All Commissioners Voting Aye.

Forest Service 25% Fund
The commission discussed the three options that are included in the Federal Legislation that the forest service has presented to the county for Forest 25% Fund. The options are…

Option 1  Continue as in the past to receive 25% of Forest receipts that are generated in Duchesne County

Option 2  Title II, which is to form a Resource Advisory Committee (RAC) and participate with a wide variety of agencies in projects in Duchesne County with Department of Agriculture approval.

Option 3  Title III which is to participate with the Forest Service without a RAC and without Department of Agricultural participation. A wide variety of Cooperative projects can be implemented.

Duchesne County has chosen to participate with the Forest Service by electing the "high three" option or full payment amount under Title III. The three high years are 1994, 1995, and 1996. The average for the three years is $181,815.88. Furthermore Duchesne County has opted under Title III to not form a Resource Advisory Committee (RAC). The county will meet with the Forest Service to work out the details.

Motion: Commissioner Ross motioned to elect the Title III option as explained above. Commissioner Stradinger second. The motion carried. Roll Call Vote: All Commissioners Aye.

Auditor's Office - Vouchers - Department Head Time Sheets - Tax Adjustments - Personnel Issues   Timesheets: Diane Freston, Clerk-Auditor presented the Commissioners with Department Head timesheets for their signatures.

Vouchers: Diane Freston Clerk/Auditor presented vouchers #71802 to #71822 totaling $179,106.34 and #71830 to #71939 totaling $165,954.34 for the year 2000 expenses for approval. Also Vouchers #71823 to #71829 totaling $17,134.30 and #71940 to #72032 totaling $70,374.13 for the year 2001 expenses for approval.  Motion: Commissioner Stradinger motioned to approve the Vouchers. Commissioner Ross second. The motion carried. Roll Call Vote: All Commissioners Voting Aye.

Other…    
Curtis Dastrup asked the commission if the matching funds for Predator Control would be coming from the department of agriculture livestock fund. Commissioner Ross replied that he assumed that this program is an extension of the Department of Agriculture Predator Program.

Michael Brennon of Sherrick Computer asked Commissioner Ross for his reason for opposing the motion for Sherrick's bid for computer service. Commissioner Ross replied that he has reservations because of the manner in which Mr. Brennan left the county's employ. Your employment was not up to standard. Mr. Brennan said that was funny because his employment file had all excellent reviews in it.

Executive Session - Pending Litigation - Roger Holfeltz
Motion: Commissioner Stradinger motioned to go into Executive Session concerning Pending Litigation. Commissioner Ross second. The motion carried. Roll Call Vote: All Commissioners Voting Aye.

Motion: Commissioner Stradinger motioned to go out of Executive Session when finished. Commissioner Ross second. The motion carried. Roll Call Vote: All Commissioners Voting Aye.
