MINUTES FOR REGULAR COMMISSION MEETING HELD DECEMBER 18, 2000 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R. Thayne, Commissioner F. Ted Kappen and Commissioner Larry S. Ross.

Others Present:  Diane Freston, Clerk/Auditor, Acting Road Supervisor Jerry Lisonbee, Clayton Chidester, Planning & Zoning, Bob West, Roland Uresk, Kris Bancroft, Kelari Kellar, Michael Brennan, Troy Sherrick, Sue Coleman, Beverly Park, Leslie Whiting, Jean Liddell and Carol Casey.

Minutes: Minutes of December 11, 2000 were read by Commissioner Thayne.  Motion: Commissioner Ross motioned to approve the minutes with corrections. Commissioner Kappen second. The motion carried. Roll Call Vote: All Commissioners Voting Aye.

Road Items - Acting Road Supervisor Jerry Lisonbee
Jerry referred to the recent snowfall stating that the wind is causing a problem with drifting snow in the Tabiona area. The plows are keeping busy.

Commissioner Ross commented on the issue of the 2477 roads and the 1903 & 1904 maps. He would like a copy of the maps sent to Stephen G. Boyden, Assistant Attorney General identifying our 2477 roads. Commissioner Thayne suggested to Jerry that he also send a copy of the old BLM-B road maps to Attorney Boyden's office, and also to the BLM.

Motion: Commissioner Ross motion the have Jerry Lisonbee prepare a letter to be sent to the Attorney General's Office identifying the old 1903 & 1904 maps as principle evidence of roads and trails in Duchesne County. Commissioner Kappen second. Motion carried. Roll Call Vote: All Commissioners voting Aye.

Discussion of Computer Contract Bids - Jack Wood
Jack presented the list of proposed bids. There is some confusion as to which chipset on the mother board is best to go with, and which kind was asked for in the bid request.

Mr. Sherrick feels that his bid is being hoisted because of misinterpretation. He believes that the bid request was lacking in specifics in the first place.

Commissioner Thayne asked Jack for his recommendation. Jack stated that all of the bids were lacking in certain areas, and he feels that the proposal should have been worded differently. His recommendation is with Micron, but they are an out of Basin company, and their warranty service is for next day.

Motion: Commissioner Kappen motioned to reject all the bids and to prepare a more specific list of equipment requirements. All requirements on the list must be included in the bid or the bid will be thrown out. Commissioner Ross second. Motion carried. Roll Call Vote: All Commissioners voting Aye.

Mr. Sherrick and Mr. Brennan are concerned because the bid prices have been disclosed, and feel their level of service is compromised because of this.

The commission specifically stated that they are after good machines, good tech support and a good price in computer equipment and software.

Public Hearing - CDBG Minutes of December 11, 2000
Laurie Brummond is unable to attend the meeting today therefore the CDBG Minutes will be approved in the December 28th commission meeting.

Tax Issues - Bob West
Mr. West stated he was in the process of closing on a property for a client. There is a problem with the Personal Property that has been attached to the property. The State Tax Commission audited the personal property reported in prior years and put an escaped lien on the property after closing amounts had been collected for the sale. The personal property is not there anymore and Mr. West is asking that an adjustment be made so that he could complete the closing. The Commissioners, Mr. West and Kris Bancroft from the assessor's office discussed the issue at length.

Motion: Commissioner Ross motioned to reduce the taxes by $2,500.00 (½ the escaped tax amount) plus penalty and interest on that amount for property 00-001-5416 in the Roosevelt Area. Commissioner Kappen second. Motion carried. Roll Call Vote: All commissioners voting Aye.

Resolution 00-29 - Establishing Duchesne County as a 21st Century Community - Kelari Kellar

RESOLUTION NO. 00-29
Establishing Duchesne County as a 21st Century Community

WHEREAS Duchesne County desires to become a 21st Century Community, and

WHEREAS Duchesne County has established a 21st Century Vision Statement, and

WHEREAS Duchesne County has developed a 21st Century Plan, and

WHEREAS Duchesne County has implemented a 21st Century Project, and

WHEREAS Duchesne County has agreed to participate in selected training programs available to assist in becoming a 21st Century Community, and

WHEREAS Duchesne County has completed the 21st Century Community Profile

THEREFORE Duchesne County looks forward with excitement and enthusiasm to becoming a 21st Century Community with signs, celebrations, rewards and recognition,

NOW, THEREFORE, BE IT RESOLVED THAT Duchesne County has given a press release declaring their intent to participate in the 21st Century Community Program,

BE IT FURTHER RESOLVED that Duchesne County have hereby followed all of the guidelines and provisions set forth to establish a 21st Century Community and have adopted this Resolution in an open meeting. This Resolution is effective upon execution.

DATED this 18th day of December, 2000

Motion: Commissioner Kappen motioned adopt Resolution 00-29 to establish Duchesne County as a 21st Century Community. Commissioner Ross second. Motion carried. Roll Call Vote: All Commissioners voting Aye.

Board Members Nomination - Tri-County Continuum of Care Planning Board - Kelari Kellar   Kelari Kellar is nominating Clayton Chidester for the Continuum of Care Planning Board Team Leader. She is also nominating the Duchesne County Commissioners, and Irene Hansen of the Chamber of Commerce as board members.

Motion: Commissioner Ross motioned to appoint those mentioned to the board of Tri-County Continuum Care. Commissioner Kappen second. Motion carried. Roll Call Vote: All Commissioners voting Aye.

2001 Planning & Zoning Board Appointment - Clayton Chidester  Clayton informed the Commission that he had not received any applications for this position. It was decided to table the appointment of an Upper Country Seat for two weeks.

Resolution 00-28 - A Resolution Amending Resolution 98-20, A Duchesne County Public Land Use Committee and Establishing it's Membership.  (Refer to Clerk's Office).

Motion: Commissioner Ross motioned to adopt Resolution 00-28 appointing said persons to two, three, and four year terms. Commissioner Kappen second. Motion carried. Roll Call Vote: All Commissioners voting Aye.

Approval to Amend Duchesne County Enterprise Zone - Cedar View Area  Motion: Commissioner Ross motioned to amend the Duchesne County Enterprise Zone to include Cedar Residential Treatment Center. Commissioner Kappen second. Motion carried. Roll Call Vote: All Commissioners voting Aye.

Approval of Deputy County Attorney Roland Uresk 2001 Contract
The contract with County Attorney Gillespie and Deputy Attorney Roland Uresk was discussed by the Commission and Mr. Uresk. Commissioner Ross stated that he wants in the contract that county government get adequate legal time for the county's needs. Mr. Uresk assured the commission that he will be available every Monday all day and on Tuesday afternoons at the administration building for the coming year 2001.  (Agreement for Legal Services attached)

Motion: Commissioner Ross motioned to approve the Agreement between Duchesne County Attorney and Deputy Attorney Roland Uresk for 2001 legal services with the increase of $5,000/yr. Commissioner Kappen second. Motion carried. Roll Call Vote: All Commissioners voting Aye.

Motion: Commissioner Kappen motioned to approve the 2001 Budget - All Funds with corrections. Commissioner Ross second. Motion carried. Roll Call Vote: All Commissioners voting Aye.

Approval of Duchesne County Share of Lobbying Expense for Proposed Severance Tax Legislation

1999 Oil & Gas Production by County and Resulting Share of Lobbying Expense (Refer to Clerk's Office).

Motion: Commissioner Ross motioned to accept Duchesne County's share of $2,633.25 for lobbying expenses for proposed Severance Tax Legislation. Commissioner Kappen second. Motion carried. Roll Call Vote: All Commissioners voting Aye.

Wasatch Electric - Service Agreement for Fire Alarm Control Systems -- Neal Potter   Neal Potter explained that the Agreement with Wasatch Electric was for all the County Buildings at an annual fee of $,3,840.00 and recommended that it be approved.   (Copy of Agreement on file).  Motion: Commissioner Ross motioned to accept the Agreement with Wasatch Electric for Fire Alarm Systems. Commissioner Thayne second. Motion carried. Roll Call Vote: All Commissioners voting Aye.

Review of County Board Appointments - Postponed until next Commission meeting on December 28, 2000.

Disclosure Statement by Herbert Wm Gillespie
Clerk/Auditor Diane Freston presented a disclosure statement prepared by Attorney Gillespie.  (Refer to Clerk's Office).  Motion: Commissioner Ross motioned to accept the disclosure statement into the record to be on file in the Clerk/Auditor's office for review. Commissioner Kappen second. Motion carried. Roll Call Vote: All Commissioners voting Aye.

Auditor's Office - Vouchers - Tax Adjustments
Vouchers: Diane Freston Clerk/Auditor presented vouchers # 71423 to #71516 totaling $577,274.35 for Commission approval.  Motion: Commissioner Kappen motioned to approve the Vouchers. Commissioner Ross second. Motion carried. Roll Call Vote: All Commissioners voting Aye.

Motion: Commissioner Kappen motioned to go into Executive session to discuss possible litigation. Commissioner Ross second. Motion carried. Roll Call Vote: All Commissioners voting Aye.
