MINUTES FOR REGULAR COMMISSION MEETING HELD OCTOBER 30, 2000 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R. Thayne, Commissioner F. Ted Kappen and Commissioner Larry S. Ross.

Others Present:  Road Supervisor, Douglas Nielsen, Diane Freston, Clerk/Auditor, Paul Lammers, Ed Giles, Jason Giles, Mike Brennan, Troy Sherrick, Susan Coleman, Beverly Park and Regina Burnhurst.

Pledge of Allegiance

Minutes: Minutes for October 23rd were ready by Commissioner Thayne.  Motion: Commissioner Kappen motioned to approve the minutes with corrections, Commissioner Ross second. The motion carried. Roll Call Vote: All Commissioners voting Aye.

Road Items - Supervisor Douglas Nielsen
Supervisor Nielsen remarked that he did not have any new information on the BIA road project until he hears from Rex Harrison of Horrocks Engineers.

Doug stated that Cindy Smith had contacted him regarding the School Bus road issue, she has more information on the road in question and when Cindy gets all the necessary paper work she will meet with the Commission again.

Commissioner Ross asked Supervisor Nielsen when the Road Asphalt and Lay-Down Work Contract Opening would be. Doug stated that it would be on November 13th at 9AM in conference room #1.

Commissioner Kappen informed Doug that Kent Parsons would be taking some TV equipment to the Tabby Mountain TV towers on Wednesday November 1st With the approaching storm this week Commissioner Kappen is requesting that Doug make sure the road on the mountain is plowed if need be.

Assessor Office - Paul Lammers - Roll Back Taxes
Mr. Lammers addressed the Commission, he stated that he lives in Heber, he is requesting a reinstatement of Greenbelt to his property (56 acres) in Duchesne County. Mr. Lammers stated that the problem was his fault, (he missed the filing date) but the property has not changed use. It is still used as agricultural. The Commission asked the Assessor's office if they approved the reinstatement. Virginia Allred - Assessor office stated the Assessor approvals. The Assessor, Greg Garff was called, who also gave his approval.

Motion: Commissioner Ross motioned to accept the Assessor's Office approval for reinstatement after the late fee is paid of Mr. Lammers property to Greenbelt. Commissioner Kappen second. The motion carried. Roll Call Vote: All Commissioners Voting Aye.

Computer Systems - Mike Brennan & Troy Sherrick
Mr. Brennan addressed the Commission and the group. He presented a proposal by Sherrick Communications for hardware and some software for the county computer department. This was a proposal only. It was not a bid process proposal and was presented only as information. Mr. Brennan stated that he feels they could service the Counties computer needs for less than what the current budget is and stated that they would accept any time frame on the contract, and added that the County could terminate the contract at any time if the county decided to bid out these services.

Judy Mutton feels there could be a problem if a computer were to go down after hours. Mr. Brennan stated that they would either fix that computer or replace it within four hours regardless of when it goes down.

Carolyne Madsen asked about the GIS completion. Mike stated they would work together to set-up a time table to get things done, and also for training.

Mr. Brennan mentioned they were bonded and had liability insurance.

Commissioner Ross stated that if the County did decide to go this route for Computer services, the County would have to go thru the public bidding process.

Commissioner Thayne asked if there were any other questions, and thanked Sherrick Communications for their presentation.

Assessor's Office - Bob West - Roll Back Taxes
Mr. West of R.S. West Real Estate stated that he had requested the removal of Greenbelt form several properties, because he thought they were sold, as it happens they didn't sell and he would like to have them reinstated.

Commissioner Ross asked Assessor Greg Garff if these properties would qualify for reinstatement. Greg replied that they would but he did not have the authority because the date had passed for application.

Motion: Commissioner Ross motioned that in-as-much as the properties have not sold and have continued their original use that the Greenbelt be reinstated and the roll back taxes be abated on subdivision properties Caroline 003 and Eagle 3-1, 3-13, 3-14. Commissioner Kappen second. The motion carried. Roll Call Vote: All Commissioners Voting Aye.

Mr. West had one other item to discuss. He was representing a property owner of Eagle Subdivision 2-7 who bought property from him. The owner is requesting help with her taxes. Mr. West stated that the property value has gone up in addition to the Roll back tax, making it a hardship for her to pay the taxes. Commissioner Ross stated that the Commission is not in favor of the Roll Back Tax Law, but there was nothing they could do within the law to lower her taxes and suggested the property owned be made aware of the time frame for Board of Equalization for next year if she questions value.

Motion: Commissioner Kappen motioned that the Roll Back Tax on Eagle Lot #002-007 remain as is. Commissioner Ross second. The motion carried. Roll Call Vote: All Commissioners Voting Aye.

Disclosure Statement - Herbert Wm. Gillespie
Clerk/Auditor - Diane Freston presented a disclosure statement from Attorney Gillespie to the Commission for their review. As per law the commission acknowledged receiving disclosure statement.  (See statement in Clerk's Office).

Assessor's Office - Ed Giles - Tax Issues
Mr. Giles stated that he had not reviewed his property evaluation notice when it was sent, and when he received his tax notice he was quite surprised to see the value had risen so much on his property in Bluebell. He is remodeling an older home on the property, and it is approximately 1/3 finished. The addition is not livable at this time and he feels the value is too high.

Commissioner Thayne answered that the time for Board Of Equalization had passed and advised Mr. Giles to have the Assessor's office visit his property for another assessment to see if an error had been made.

Motion: Commissioner Kappen motioned to approve the Tax Adjustments. Commissioner Ross second. The motion carried. Roll Call Vote: All Commissioners Aye.

Auditor's Office - Vouchers - Department Head Time Sheets - Tax Adjustments 

Setting of Commission Dates to replace 12/25/00/and 1/1/01 which are Holidays  December 28, 2000 was set as an extra Commission meeting day beginning at 9 AM in the commission board room in Duchesne, Utah. The swearing in of new elected officials will be January 2, 2001 at Noon in the commission board room in Duchesne, Utah.

Timesheets: Leann Stewart, Deputy Clerk-Auditor presented the Commissioners with Department Head timesheets for their signatures.

Vouchers: Diane Freston Clerk/Auditor presented vouchers #70800-#70868 totaling $84,167.18 for approval.  Motion: Commissioner Kappen motioned to approve the Vouchers, Commissioner Thayne second. The motion carried. Roll Call Vote: All Commissioners Voting Aye.

The software licensing agreement of the county taxroll maintenance system known as CTxMS was reviewed. (See agreement in Clerk's Office).  Motion: Commissioner Ross motioned to sign the CTxMS agreement. Commissioner Kappen second. The motion carried. Roll Call Vote: All Commissioners Voting Aye.
