MINUTES FOR REGULAR COMMISSION MEETING HELD OCTOBER 23, 2000 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R. Thayne, Commissioner F. Ted Kappen.

Commissioner Absent: Commissioner Ross was in other meetings.

Others Present:  Diane Freston, Clerk/Auditor, Road Supervisor Douglas Nielsen, Neal Potter, Clayton Chidester, Diana Stevens.

Pledge of Allegiance

Minutes: Minutes for October 16, 2000 were read by Commissioner Thayne.  Motion: Commissioner Thayne motioned to approve the minutes with corrections, Commissioner Kappen second. The motion carried. Roll Call Vote: Both Commissioners Voting Aye. 

Road Items - Supervisor Douglas Nielsen
Supervisor Nielsen and Clayton Chidester from Planning and Zoning presented the commission with the attached list of roads that had been prioritized by the Planning and Zoning committee for the commissions review.  (See attached letter in Clerk's Office).

Follow-up on Cindy Smith road request.  Doug reported that the road plotted on the Cedar Mtn #9 map Cindy Smith presented to the commission does not exist. The road referred to be a county road is a private road. The county cannot accept the road as a county road.

Doug spoke with Greg Searle concerning the Bridge work and completion dates. The constructions bids for bridges 4,5,6,7 were noticed October 21, 2000. The bid opening will be November 21, 2000. The construction is scheduled to begin December 21, 2000 with completion being calendared as June 21, 2001.

The Bluebell road 60 mph signs are now up with a 45 mph advisory sign around the curves in the road.

The trees at Will's Trailer Court will come down after the leaves fall off the trees as the leaves clog up the machinery.

The salt and sand has been mixed for winter and is ready and the road department will be putting shale on pleasant valley roads this coming week.

Mr. Nielsen also reported that he had talked to Vern Palmer from the BIA concerning the Arcadia Road. Mr. Palmer will be talking to Rex Harrison from Horrocks Engineering and a meeting will be scheduled to work out details on the road work.

Discussion of Bidding Process for 2001 Road Asphalt and Lay-Down Work  The specifications for the asphalt batch plant bid for 2001 road work were discussed.  Motion: Commissioner Kappen motioned to give Road Supervisor Douglas Nielsen authority to prepare the final bid for the asphalt batch plant bid for 2001 and after commission approval to publish the bid in the Uintah Basin Standard and send copies to all road construction companies in the county. Commissioner Thayne second. The motion carried. Roll Call Vote: Both Commissioners Voting Aye.

Discussion and Adoption of Resolution 00-18 - A Resolution Adopting a Policy Regarding Sale of Surplus Property of the County  The following resolution was read and discussed. The original resolution #98-34 indicated that the county sell surplus property twice a year. This resolution changes the surplus sale for land and items to once a year.

RESOLUTION NO. 00-18
A RESOLUTION AMENDING RESOLUTION #98-34
ADOPTING A POLICY REGARDING
SALE OF SURPLUS PROPERTY OF THE COUNTY

WHEREAS Duchesne County has from time to time certain property which it owns or has under its control which it deems surplus, and

WHEREAS a public sale of surplus property by way of auction would be in the best interest of Duchesne County and the general public, and

WHEREAS it has been determined by the Board of County Commissioners of Duchesne County that a regularly scheduled surplus sale would increase the number of bidders and proceeds,

BE IT HEREBY ORDAINED by the Board of County Commissioners for Duchesne County that:
Duchesne County shall sell its surplus property by way of regularly scheduled public auctions to the highest bidder.
That public auction of surplus property shall be held once a year, on the second Saturday of April beginning April, 2001.
Property sold at the surplus sale shall be that which has been previously deemed surplus by order of the Board of County Commissioners of Duchesne County.

The Board of County Commissioners shall, prior to the sale, adopt the rules of sale to be in effect during the sale.  Notice of the sale shall be published two (2) times prior to the sale.

DATED this 23rd day of October, 2000.

Discussion and Adoption of Resolution 00-19 - A Resolution Adopting a Policy for County Travel and Mileage Reimbursement  The following resolution changing the county reimbursement mileage was read.

RESOLUTION NO. 00-19
A RESOLUTION ADMENDING RESOLUTION #98-05,
ADOPTING POLICY FOR COUNTY
TRAVEL AND MILEAGE REIMBURSEMENT

WHEREAS it is necessary from time to time for public officials of Duchesne County and their staff to travel outside the Duchesne County area, and

WHEREAS the County has purchased vehicles for the use by public officials and their staff for travel, and

WHEREAS the County encourages the public officials and their staff to use the County vehicles for travel, and

WHEREAS the cost of fuel has increased,

BE IT THEREFORE RESOLVED by the Board of County Commissioners for Duchesne County that:  All public officials and their staff are encouraged to use the County vehicles for purposes of County travel. 

Elected officials and department heads are encouraged to use the most practical, cost-effective and efficient means available for County travel.

Mileage reimbursement shall be at the rate of thirty-one cents ($0.31) per mile for private vehicle usage.

Auditor's Office - Vouchers - Tax Adjustments
Diane Freston presented the commission with the indigent hardship applications for the commission review. Property 00-030-6500, 00-001-9061 and 00-001-9939 qualified for the abatement.

Vouchers: Diane Freston Clerk/Auditor presented vouchers #70716 to #70799 and pre-draw #67522 totaling $46,127.87 for approval.  Motion: Commissioner Kappen motioned to approve the Vouchers, Commissioner Thayne second. The motion carried. Roll Call Vote: Both Commissioners Voting Aye.

Judy Mutton - Update of Policy & Procedures Manuel discussion   Judy Mutton, Personnel Director presented various changes to the Policy and Procedure manual that had been discussed in the last few months for discussion. The following sections we discussed the date of November 13, commission meeting was set to adopt the changes.

SECTION 3 - ANIT-NEPOTISM (3.3);

SECTION 4 - CLASSIFICATION/RECLASSIFICATION (4.4d) (4.5);

SECTION 6 - EMPLOYMENT STATUS (6.5) (6.5a) (6.5.c) (6.6e) (6.8a) (6.9a) (6.11b) (6.11d);

SECTION 8 - COMPENSATION - (8.3a) (8.3.d.c) (8.7) (8.7d) (8.7e) (8.8b) (8.8d) (8.9a) (8.10a) (8.11a).

Assessor's Office - Mail in BOE appeal recommendations and any other Board of Equalization Issues  The following properties were discussed as BOE appeals with the following decisions. In addition November 8th from 9AM to NOON was set for an additional BOE hearing date for the public.
