MINUTES FOR REGULAR COMMISSION MEETING HELD OCTOBER 16, 2000 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R. Thayne, and Commissioner Larry S. Ross.

Commissioner Absent: Commissioner F. Ted Kappen was ill.

Minutes: Minutes for October 2, 2000 were read by Commissioner Thayne.  Motion: Commissioner Ross motioned to approve the minutes with corrections. Commissioner Thayne second, the motion carried. Roll Call Vote: Both Commissioners Voting Aye.

Recognition of Sheriff Stansfield
The Duchesne County Commission presented a certificate and an over-night stay at the LC Ranch plus dinner for two to Sheriff Ralph Stansfield. They also thanked him for his dedicated service to Duchesne County. Sheriff Stansfield has been named "Utah Sheriff of the Year" by the Utah Attorney General's Office.

Road Items - Supervisor Doug Nielsen
Supervisor Nielsen presented Request #14 for design work on bridges DS-S04, DS-S05, DS-S06, DS-S07 in the amount of $7,238.66 which is the balance of a $144,580 contract with Horrocks Engineers on a 80/20 match with UDOT. Commissioner Ross pointed out that the proposed contract stated that the project would be completed in three (3) months and he feels that this is a mistake. Supervisor Nielsen agrees, he will contact Greg Searle, Region 3 Project Manager, to have it corrected.

Motion: Commission Ross motioned to approve Request #14. Motion second by Commissioner Thayne. Motion carried. Roll Call Vote: Both Commissioners Voting Aye.

Doug informed the Commission that he checked the plat maps to clarify ownership of the proposed school bus road on Cedar Mountain. Cindy Smith had come before the commission on October 2nd requesting that the school bus use this road to pick up the children in that area. The road in question is on private land, and is not on the plat map.

Supervisor Nielsen stated that the two trees on Ostler's Corner had been removed. The tree by Keith Jensen in Hancock Cove will be taken care of along with the tree in Bluebell.

Commissioner Ross noted that the speed limit signs on the Bluebell Road needs to be revised. The section from the Jenkins place east should be changed from 55 mph to 60 mph.

Cove Acres property owners - Raymond Nelson - Subdivision Concerns  Mr. Nelson addressed the Commission stating that he purchased land in Cove Acres from the County at the May Tax Sale and has had difficulty finding the lots in the subdivision. The original plats are dated 1978, they were never reconciled to property deeds, and they have no streets marked on the plats either. Mr. Nelson stated that unless the Commission could find a solution to the survey problems at Cove Acres that the property is useless.
Mr. Nelson presented the following statement that he had prepared: 

COVE ACRES: 

1165 lots, almost all are .50 acres.  600 property owners.
Duchesne County currently owns 29, of which 14 will be offered for sale at the Nov. Surplus sale.

GOAL: To find a solution to the survey problems which is cost effective and is distributed evenly to each property.

Background: Cove Acres subdivision plat maps are dated in 1978 although the one and only property owner has been there since 1972. (Donald Johnson). According to two surveyors, Jerry Allred and Ned Davis (Vernal) a survey is virtually impossible because 1. Original plat maps were not reconciled to the deed 2. Mr. Davis said there was no starting point to begin the survey. In order for a survey to be done the outside corners of the subdivision must be marked and it would be helpful if each of the streets were marked. A cost that is too expensive for one landowner to absorb. Mr. Allred quoted about $2000.00 "to just get started."

In the past few months we have mailed to each property owner a letter explaining the situation. To date we have heard back from 70 people. Of which only one person said that she would not participate in improvements.

We were told by Karl Mott and Diane Freston that in order to get a building permit we would have to have one acre of ground, due to perk test requirements. (Although, to our knowledge, no perk tests have been done to verify this.) We did ask the property owners if they would buy or sell an adjacent property to make the 1 acre requirement and the response was favorable.

PROPERTY TAX COLLECTED: 1165 lots @ 10.78 per lot = $12,558.70.   For 1999 1165 lots @ 7.50 (approx.) per lot x 22 years = $192,226 1978 thru 1999.  

SOLUTIONS:

  1. 1. Form a Special Service District, which would probably cost more than the survey.

  2. Duchesne County pay for survey out of the property taxes collected.

  3. Declare the property as "useless" and zero out all the taxes.

The Commission directed Mr. Chidester to work with Mr. Nelson and our county surveyor to correct the problems in Cove Acres.

Zone Change - Matt Martinez
Susan Hamilton of Freedom Reality will be the representing agent for Mr. Martinez. Mrs. Hamilton stated that Mr. Martinez purchased the property in 1999, it is a 1.99 acre lot in a 5 acre zone. An older home is currently on the property, the water connection is there, and the lot has been taken off greenbelt in order to conform for the zone change.

Robert Meeks stated that he lives across the road from this property is not in favor of the zone change, he feels that if an exception is made now more will follow. Mr. Meeks is not happy with the Planning and Zoning Board's favorable recommendation. Commissioner Ross stated that the decision for the zone change was made by the Planning and Zoning board, and that any other property sold in the area would have to conform to the Zoning Ordinance.

Motion: Commissioner Ross motioned to approve the zone change noting that the approval is for this one property only. Commissioner Thayne second. The motion carried. Roll Call Vote: Both Commissioners Voting Aye.

Clyde Watkins - Tax Issues
Mr. Watkins is not complaining about his taxes he just wants the commission to be fair in their appeals process. He has received two notices from the county this year, the first notice valued his property at $67,000 then it went to $77,000, this is up $51,000 from the previous year. It seems that if you come before the B.O.E. Board, your taxes are dropped making it unfair for the taxpayer who doesn't appeal.

Kris Bancroft explained that the reason he received and second valuation was because they had just finished reappraising Altamont City. He stated that Mr. Watkins or anyone who had received the second notice had the right to appeal for 30 days after the notice was sent out. The commission suggested that when the assessor sends out corrected notices that a letter explaining that the taxpayer has a right to appeal and the process be sent also.

Georg Adams - Lifting County Fire Moratorium
Georg Adams indicated that it was now safe to lift the county fire moratorium that was placed in affect last summer.  Motion: Commissioner Ross motioned to lift the county fire moratorium. Commissioner Thayne second. The motion carried. Roll Call Vote: Both Commissioners Voting Aye.

Roger Holfeltz - Executive Session, Litigation
Motion: Commissioner Ross motioned to go into Executive Session to discuss Possible litigation. Commissioner Thayne second. Motion carried. Roll Call Vote: Both Commissioners Voting Aye.

Motion: Commissioner Ross motioned to go out of Executive Session when finished. Commissioner Thayne seconded. Motion carried. Roll Call Vote: Both Commissioners Voting Aye.

Christie Ivie - Senior Health Day
Mrs. Ivie stated that the Uintah Basin Medical Center will be hosting Senior Health Day at the Crossroads Center on November 7th, and the Gateway Center on November 9th . They will have personnel from the hospital to offer health services to the seniors during the day, and door prizes will be awarded. Christie is here to ask the Commission for a donation for the door prizes.

Motion: Commissioner Ross motioned to donate $100.00 to be split between the two centers fairly for the event. Commissioner Thayne second. The motion carried. Roll Call Vote: Both Commissioners Voting Aye.

Laurie Brummond, UBAG - UDOT Contract
Laurie related to the Commission that the county had received additional funding from UDOT to purchase a 15 passenger van for the senior program at a total cost of $25,250.00, and a small bus ADA approved for the senior program at a total cost of $50,875.00. The county's 20% match cost for the vehicles will be $15,125.00 which will need to be budgeted for.  

Motion: Commissioner Ross motioned to sign the contract as to description and price cost. Commissioner Thayne seconded. Motion carried. Roll Call Vote: Both Commissioners Voting Aye.

Laurie Brummond - Approval of Revitalization Funds Contracts   The revitalization contracts were reviewed to be as follows: 

USU Building - Nov 1999 to Dec 2000 funds:  $ 28,960.0

USU Building - 2001 year funds:  $ 71,040.00

Crossroads Building Handicapped Entrance - 2001 funds:  $ 20,854.00

Mickelson Building Improvements - 2001 funds:  $ 6,357.00

Motion: Commissioner Ross motioned to officially adopt for finalization the revitalization contract as presented by Laurie Brummond. Commissioner Thayne seconded. Motion carried. Roll Call Vote: Both Commissioners Voting Aye.

Jamie Park - County Fair Building Use and/or Rental Policy
Jamie presented the following policy to the Commission for their approval.

COUNTY FAIR BUILDING USE AND/OR RENTAL POLICY
The applicant hereby requests the privilege of using the County Fair Building and agrees to abide by and be subject to the following conditions:

Applicant and/or the organization are responsible for all damages or loss incurred at the building during applicant=s use thereof.

Applicant and or the organization are responsible for cleaning the rental and surrounding area at the conclusion of agreed usage. Any trash left or damage to the exterior of the building will be the responsibility of the applicant.

The Center will not be responsible for the loss or damage of equipment, art work, decorations, injuries or any other personal belongings or items owned by the organization or individuals using the center.

The applicant and/or organization will be responsible for discipline and reasonable and prudent use of the building.

Rulings of the Duchesne City Fire Department as to room capacity, aisle space and other related matters will be observed.

Permission to use the building includes use of tables and chairs which are already in place.

Deposits are non-refundable if cancellation of rental occurs within the one week period prior to the rental date.

Any cleaning or repairs done by Center personnel will be charged against the deposit at the rate of $25.00 (twenty-five) per hour.

The Duchesne County Commission reserves the right to refuse the use and/or rental of the County Fair building to any individual or group.

Deposit checks will be issued in 21 days or less.

An additional $50 will be charged if alcohol will be present. An off duty-post certified person must be there (the renter pays for him/her), and you must get an alcohol license from Duchesne City. If your event is alcohol related and you said you weren=t going to have alcohol your entire deposit will be lost.

CANDLES, HURRICANE LAMPS OR ANY OPEN FIRE MAY NOT BE USED IN THE BUILDING.

Uintah Basin Mental Health - Discussion to Amend Agreement for Janitorial Services  Mr. Potter stated that Uintah Basin Mental Health were requesting janitorial services for the restrooms at there old courthouse rental. He explained that the services were not included in the rental contract, and his personnel did not have the time to provide the service.

Commissioner Ross commented that if Uintah Basin Mental Health needs this service, they should hire someone to provide it for them.  Motion: Commissioner Ross motioned to leave the rental contract as is. Commissioner Thayne seconded. Motion carried. Roll Call Vote: Both Commissioners Voting Aye.

Auditor's Office - Vouchers - Department Head Time Sheets - Tax Adjustments 

Timesheets: Leann Stewart, Deputy Clerk-Auditor presented the Commissioners with Department Head timesheets for their signatures.

Vouchers: Diane Freston Clerk/Auditor presented vouchers #70532 to #70558 totaling $147,947.58 and vouchers #70559 to #70715 plus pre-draw #67523, #67524 totaling $294,226.30 for approval.  Motion: Commissioner Ross motioned to approve the Vouchers, Commissioner Thayne second, the motion carried. Roll Call Vote: Both Commissioners Voting Aye.
