MINUTES FOR REGULAR COMMISSION MEETING HELD AUGUST 21, 2000 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R. Thayne, Commissioner F. Ted Kappen and Commissioner Larry S. Ross.

Others Present:  Carol Casey, Deputy Clerk/Auditor, Road Supervisor Douglas Nielsen, County Attorney Herb Gillespie, Jack and Barbara Burgess, Sue Coleman.

Prayer: Commissioner Guy Thayne
Pledge of Allegiance

Minutes: Minutes for August 14, 2000 were read.  Motion:   Commissioner Kappen motioned to approve the minutes with corrections, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioner Aye.

Executive Session - Possible Litigation Pertaining to a Billing from Alan Williams, Attorney for Gary Mitchell, Indigent Person  Motion: Commissioner Ross motioned to go into executive session to discuss litigation with the County Attorney, Commissioner Kappen Second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Motion: Commissioner Kappen motioned to come out of executive session when the discussion was concluded, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Motion:   Commissioner Ross motioned to pay the billing submitted by Alan Williams, in the amount of $3075.00 IN FULL. Motion second by Commissioner Kappen Roll Call Vote: All Commissioners Voting Aye.

Commission meeting reconvened 1:30 PM

Road Items - Supervisor Doug Nielsen
Supervisor Nielsen reported that payment request #13 for $4159.07 will complete Strawberry Bridges contract with Horrocks Engineering for pre construction Engineering.

Motion: Commissioner Kappen motioned to pay the billing, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Commissioner Ross informed those present that the money used for this project is from a UDOT agreement, 80% State funds and 20% County.

The Commission asked Supervisor Nielsen if there had been any progress in the Arcadia Road project. Doug stated that Alan Floyd is arranging a meeting with BIA in September, the Commission will be invited.

Paving is complete at the Tabiona Fire Station, Doug will talk to Georg Adams about concrete bumpers and sealing.

The Road Department paved ½ mile on the Red Creek Road this past week while waiting for the North Fork job.

Commissioner Thayne asked Mr. Nielsen how many miles the department has chipped this summer. Doug replied that they have chipped 33 ½ miles.

Roger Holfeltz would like Mr. Nielsen to sweep the corner at 7000 North on the Lake Fork River Road . He stated that his light car seems to slide on the chips when he drives around the curve. Doug will touch up the corner, and it was suggested that Roger slow down.

Commissioner Kappen related that he received a letter from the Veterans Service Alliance regarding the closing of RS 2477 roads on BLM and Forest lands. The closing of these roads is a hardship for the Handicapped, making it harder for them to reach many hunting and fishing areas, as well as general recreation for Veterans.

Motion: Commissioner Kappen motioned to send a letter of support to the Veterans Alliance. Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Aye.

Jack and Barbara Burgess - Koch Road
Mr. Burgess addressed the Commission stating that there is a 5 mile stretch of road in the Koch field that is in need of repair. He says that the sides or bar pit is approximately 2 ½ feet deep, if a car or pickup were to slip off into it they would need a wrecker to get out.
Doug Nielsen remarked that he is familiar with the area Mr. Burgess is talking about, the road is narrow in spots, a lot of ledge rock and sand, and will require some major work with a cat and scraper.
Commissioner Ross asked about Right of Way and how many feet we had in that area. No one was sure if it was a 66 or 50 foot Right of Way.

Tax Adjustments - Auditor

Motion: Commissioner Kappen motioned to approve the tax adjustment. Commissioner Ross Second, the motion carried. Roll Call Vote: All Commissioners Aye.

Auditor's Office - Vouchers - Department Head Time Sheets - Tax Adjustments

Timesheets: Leann Stewart, Deputy Clerk-Auditor presented the Commissioners with Department Head timesheets for their signatures.

Vouchers: Andrea Higbee, Deputy Clerk/Auditor presented vouchers #69788 to #69880 totaling $81,719.99, and #67530 in the amount of $312.09 for approval.  Motion: Commissioner Ross motioned to approve the Vouchers, #69788 thru #69880 totaling $81,719.99 and predraw voucher #97530 for $312.09.  Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioners Aye.

Adjournment: 2:15 PM
