MINUTES FOR REGULAR COMMISSION MEETING HELD ON JUNE 12, 2000 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R Thayne, and Commissioner Larry S Ross.

Commissioners Absent: Commissioner F Ted Kappen

Others Present:  Diane Freston County Clerk/Auditor, Shelley Brennan Executive Secretary, Clerk/Auditor's Office Taking Minutes, Supervisor Doug Nielsen. Sue Coleman, Sharon Olsen, Beverly Park, Regina Burnhurst, Linda Snow, Vicki Charman, Ted McNeil, Blaine & Elaine Berger, Diana Stevens, Dan Sawyer, Rosalyn & Tomi Thomas.

Pledge of Allegiance

Minutes: Minutes for June 5, 2000 were read.  Motion: Commissioner Ross motioned to approve the minutes with corrections, Commissioner Thayne second, the motion carried. Roll Call Vote: All Commissioner Aye.

Road Issues - Supervisor Nielsen
Supervisor Nielsen informed the Commission that he has received a letter from the Duchesne County Water Conservancy District. They are willing to purchase the gravel that will be needed for the Red Creek Canal project. The County will haul the gravel. The Water Conservancy District would like to set a date for a pre-construction meeting as soon as possible.

Commissioner Thayne stated that Alton Moon contacted him about getting the ¼ mile of the Sheering Corals road in Antelope Canyon paved. Supervisor Nielsen said that that road is scheduled to be on the Planning and Zoning Commissions Road Tour in November.

Commissioner Ross has talked to Georg Adams Emergency Management Director, about the parking lot at the Tabiona Fire Station. They would like to have the parking lots of the fire station and the medical clinic paved and sealed. They also would like guardrail placed around the propane tank and bumper blocks in front of the building.

Vicki Charman, Linda Snow and Blaine & Elaine Berger were present to ask the Commission if there was anyway the County could designate a portion of the Red Creek Road as an ATV trail. They all live in the Bandana Ranch and have just found out that they are not allowed to ride their 4-wheelers on the County Road. They all like to take the road over to Tabiona on their 4-wheelers. The Commission is not sure what they would have to do and if they could designate a portion of the road as an ATV trail. Supervisor Nielsen does not believe that the road would be safe with both vehicles and 4-wheelers traveling it, the road is very narrow in spots. The Commission and Supervisor Nielsen asked if their 4-wheelers where legal to drive on State highways. Vicki was not sure if they were or not but did not think so. The Commission would like to take a couple weeks to research this and find out what the County could and not do. This will be back on Commission Agenda on June 26, 2000.

Request for Donation for Honor Academy -
Tomi Thomas and her mother Rosalyn were present to ask the Commission for a donation to help with the money they are trying to raise so that Tomi may attend the Honor Academy. The Commission explained that in order for the County to donate any money for youth projects the recipient would have to donate to the County a project of like value that in some way benefit the County. The Commission asked if Tomi could use the things she would learn at the Honor Academy to help the community in some way. They ask her to prepare for them in writing what she would do to help the community.

Motion: Commissioner Ross motioned that upon the receipt of the proposal to the Auditors Office from Tomi Thomas that Duchesne County donate $300.00 to help Tomi attend the Honor Academy, Commissioner Thayne second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Ordinance 00-167

ORDINANCE NO. 00-167
AN ORDINANCE CHANGING THE ZONING FROM A/R-1 (AGRICULTURAL/RECREATIONAL), A 5-ACRE ZONE, TO RR-1 (RURAL RESIDENTIAL), A 1-ACRE ZONE

WHEREAS Duchesne County has adopted a zoning ordinance, zoning portions of the county for various uses, and

WHEREAS a property owner has petitioned the county to change the zoning for use from A/R-1 (Agricultural/Recreational), a 5-acre zone, to RR-1 (Rural Residential), a 1-acre zone on a parcel of property located in Section 23, Township 3 South, Range 9 West, USM., and

WHEREAS the matter has been brought before the Duchesne County Planning and Zoning Commission, and

WHEREAS the Planning and Zoning Commission has held a public hearing on said zone- change request and after due consideration recommends that the zone change be granted and

WHEREAS the Duchesne County Commission has had a full discussion of the matter in a public meeting, and

BE IT HEREBY ORDAINED as follows:
The current zoning of A/R-1 (Agricultural/Recreational), a 5-acre zone, is changed to RR-1 (Rural Residential), a 1-acre zone for the following parcel of property described as follows:
Township 3 South Range 9 West U.S.B.& M..
Section 23: BEGINNING AT NORTHWEST CORNER OF THE NE1/4NW1/4; THENCE SOUTH 262 FEET; THENCE EAST 200 FEET; THENCE NORTH 262 FEET; THENCE WEST 200 FEET TO THE POINT OF BEGINNING.

Clayton Chidester Director of Planning and Community Development and Mr. Ted McNeil were present to discuss this zone change. Clayton Chidester stated that all the requirements were met and has been approved by the Planning & Zoning. Mr. McNeil also has letters of support from surrounding property owners.

Motion: Commissioner Ross motioned to approve the zone change for Ted McNeil, Commissioner Thayne second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Auditors Office - Vouchers - Department Head Timesheets - Tax Adjustments - Personnel Issues  

Leann Stewart Deputy Clerk/Auditor presented department head timesheets for signature.

Diane Freston Clerk/Auditor presented voucher #68842 to #68942 totaling $133,499.36 for approval.  Motion: Commissioner Ross motioned to approve the vouchers, Commissioner Thayne second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Personnel Issues - Judy Mutton Personnel Director
Judy Mutton presented two draft amendments for sections in the Duchesne County Policy and Procedures Manual.

Tri County Health Department Lease Agreement
The Commission is waiting for Roland Uresk, Deputy County Attorney's amendment to the lease agreement. This Agreement will be on next weeks agenda for signature.

Discussion of the Aging Agreement with the Association of Governments  The Commission reviewed the contract and some concerns they have with the present contract. The Commission has some concerns about the maintenance of the vehicles.

Motion: Commissioner Ross motioned to send U.B.A.G. a letter requesting the maintenance reports for all the aging vehicles, if the reports are not provided the Commission will then consider voiding the contract, Commissioner Thayne second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Annual Agreement with USU Extension Office
The Commission discussed the Annual Agreement and the County's role in Utah State University Extension office & other County youth.

Motion: Commissioner Ross motioned to approve the Annual Agreement with USU Extension, Commissioner Thayne second the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Report on Seizure and Sale of Personnel Property - Roland Uresk  Roland Uresk was not present due to an illness of the County Attorney Herb Gillespie. Shelley Brennan reported to the Commission that Roland has been able to contact all but two of the companies. He is waiting to hear back from them. He will report on this in two weeks.

Appointment to the Uintah Basin Medical Board
The Commission has not finished the interviews of the applicants. This will be on the Agenda July 3, 2000.
