MINUTES FOR REGULAR COMMISSION MEETING HELD ON JUNE 5, 2000 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R Thayne, Commissioner F Ted Kappen, and Commissioner Larry S Ross.

Others Present:  Roland Uresk Deputy County Attorney, Diane Freston County Clerk/Auditor, Shelley Brennan Executive Secretary; Clerk/Auditor's Office Taking Minutes. Supervisor Doug Nielsen, Jean Liddell, Dustin & Pennie Thacker.

Minutes: Minutes for May 15, 2000 were read.  Motion: Commissioner Kappen motioned to approve the minutes with corrections, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Road Issues - Supervisor Nielsen
Supervisor Nielsen presented Payment Request #14 in the amount of $3,433.48 from Horrock Engineering for Contract No. 99-8223, Engineering Service Agreement No. STP-1544(1)5 Arcadia Road Project.

Motion: Commissioner Ross motioned to approve the payment request, Commissioner Kappen, second the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Commissioner Ross asked Supervisor Nielsen how the maps for Vista Valley, and the Red Creek road area were coming. Supervisor Nielsen said that he was working on it, it has been a bit difficult because of all the small lots in Vista Valley.

Commissioner Ross informed Supervisor Nielsen that there will be a lot of traffic using the Red Creek Road June 15th, 16th and 17th. He wondered how road conditions were from Fruitland Store North to Bandana Rand. Supervisor Nielsen said the road was as good as any other graveled County road. Supervisor Nielsen will make sure the road is graded before that weekend.

Commissioner Thayne asked Supervisor Nielsen about patching the Moon Lake Road. Supervisor Nielsen said that road was on their list to be patched this year.

Discussion of Laydown Machine
Supervisor Nielsen and the Commission discussed the bids fro laydown machine work. He has received a bid from Ned B Mitchell for the use of the laydown machine and two workers to run it for $ . Also Supervisor Nielsen received a quote from Cate Equipment for the rental of the laydown machine for $12,500.00 a month. Cate Equipment will take the entire amount of what is paid for rent and apply it to the purchase of the machine if we decide to buy it. Supervisor Nielsen would like to rent the machine for the summer and try it out.

Commissioner Ross questioned that cost involved with waiting time while using the machine & suggested that the County lay the tar sands this year by blade & consider the laydown machine next year.

Motion: Commissioner Ross motioned to have the Road Department lay tar sands this year by blade and consider the laydown machine next year, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Discussion of Tar sands - Executive Session
This item will be discussed at a later date.

Discussion of Altamont Fire Department Issues - Mayor Travis Mitchell  Mayor Travis Mitchell and Georg Adams Emergency Management Director were present to request $1,500.00 dollars to help pay for the repair of shaft on the water pump of one of the fire trucks. It will cost $3,000 to have the part repaired.

Commissioner Kappen asked about the money that the County budget's for the fire department. Mayor Mitchell stated that all that money is used for repairs of the equipment and to pay for the fire fighters. Mayor Mitchell said they have enough money to pay for the full amount of the repair, but with the way the fire season is going, he is afraid that it will cut them short at the end of the year.

Motion: Commissioner Kappen motioned to approve the request of $1,500 for the Altamont Fire Department, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Emergency Management Director Georg Adams presented the following:

OPEN BURN ORDINANCE NO. 116, 1993

8.12.030. Commission can declare immediate fire moratorium

In the opinion of the Duchesne County Commission an extremely hazardous fire condition exists, constituting a direct threat to the safety of persons ad property within the county if burning were permitted. The Commission therefore on this 5th day of June 2000 declares a fire moratorium throughout the county. No fires may be set for the purpose of clearing of unwanted grasses, brush or other unwanted matter. No fireworks shall be set off except under strict control in a non flammable controlled area. Firework rockets are prohibited in all cases. Camp fires shall be strictly controlled and shall be in a fire pit. The camp fires must be extinguished to the extent that no hot oasl remain when its use is no longer needed. Extra care should be taken in windy conditions, so as to prevent any chance of the fire4 escaping the fire pit, and at no time should the fire be left unattended.

Any fire caused from reckless burning shall be the responsibility of the person or persons starting the fire who shall bear the full cost of suppression.

Motion: Commissioner Ross motioned to approve the moratorium and have it advertised in the local newspaper and advertised on the radio stations, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

AN ORDINANCE CHANGING THE ZONING FROM A/R-1
(AGRICULTURAL/RECREATIONAL), A 5-ACRE ZONE,
TO A (AGRICULTURE), A 2.5-ACRE ZONE

WHEREAS Duchesne County has adopted a zoning ordinance, zoning portions of the county for various uses, and

WHEREAS a property owner has petitioned the county to change the zoning for use from A/R-1 (Agricultural/Recreational), a 5-acre zone, to A (Agricultural), a 2.5-acre zone on a parcel of property located in Section 32, Township 2 South, Range 1 West, USM., and

WHEREAS the matter has been brought before the Duchesne County Planning and Zoning Commission, and

WHEREAS the Planning and Zoning Commission has held a public hearing on said zone- change request and after due consideration recommends that the zone change be granted and

WHEREAS the Duchesne County Commission has had a full discussion of the matter in a public meeting, and

BE IT HEREBY ORDAINED as follows:
The current zoning of A/R-1 (Agricultural/Recreational), a 5-acre zone, is changed to A (Agricultural), a 2.5-acre zone for the following parcel of property described as follows:

Section 28: Beginning at a point being West a distance of 1998.07 ft, thence North 408.56 ft from the SE corner of said section; thence West 395.00 ft, thence North 5*56' West 497.00 ft, thence East a distance of 50.00 ft, thence South 38*43'26" East 633.63 ft to the point of beginning.

Clayton Chidester Director of Planning and Community Development and Mr. & Mrs. Dustin Thacker were present to discuss the zone change. Clayton stated that all the requirement have been met for this zone change and it has been approved by the Planning and Zoning Commission.

Motion: Commissioner Kappen motioned to approve the zone change, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Discussion of Utility Billing - Avatar
Chris Hatch was present a proposal from Avatar. Avatar audits power & natural gas utility bills for overcharges. Avatar proposed to go back 25 months billing for a 50% commission on savings. There are no upfront costs, if they find no overcharges we will not be billed. If they do find overcharges the County will be billed for half of what is recovered.

Motion: Commissioner Kappen motioned to approve the audit of the County's Utility bills, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

The Agreement was signed and is available in the Agreement Book in the Clerks office.

Auditor's Office - Vouchers - Department Head Time Sheets - Tax Adjustments - Personnel Issues

Clerk/Auditor Diane Freston presented voucher #68650 to #68841 totaling $385,884.77 for approval.  Motion: Commissioner Ross motioned to approve the vouchers, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Motion: Commissioner Kappen motioned to approve 2000 Delinquent Tax Sale, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Discussion of Agreements with Tri-County Health and Uintah Basin Association of Governments   The Lease Agreement with Tri-County Health Department will be amended. The square footage occupied by the Health Department will be reduced by 400 square feet.

Motion: Commissioner Ross motioned to reduce the square footage in the lease agreement with Tri County Health by 400 feet the price per square foot will remain the same, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

The Agreement with the Uintah Basin AOG will be discussed in next weeks meeting.

Appointment to the Duchesne County Weed Board
Stan Keller is no longer interested to sitting on the Weed Board.  Motion: Commissioner Ross motioned to appoint Shawn McConkie to fill the unexpired term of Stan Keller, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Disposition of Mental Health Trailer
Duchesne County presently owns the trailer occupied by Northeastern Counseling, the property it is located on is owned by the Uintah Basin Medical Center. Northeastern Counseling no longer wants the trailer and will be purchasing a new one for their offices. The Commission discussed options for disposal of the trailer.

Motion: Commissioner Ross motioned to have Commissioner Kappen, who represents the County on the Mental Health Board, offer the trailer to Northeastern Counseling and negotiate a price, Commissioner Kappen second the motion carried. Roll Call Vote: All Commissioners Voting Aye.

USU Agreement will be discussed at a later date.
