MINUTES FOR REGULAR COMMISSION MEETING HELD ON MAY 22, 2000 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R Thayne, Commissioner F Ted Kappen, and Commissioner Larry S Ross.

Others Present:  Roland Uresk Deputy County Attorney, Diane Freston County Clerk/Auditor, Shelley Brennan Executive Secretary, Clerk/Auditor's Office Taking Minutes. Supervisor Doug Nielsen Edith Larson, Roger Holfeltz.

Pledge of Allegiance

Minutes: Minutes for May 15, 2000 were read.  These minutes will be reviewed in the next meeting.

Commissioner Thayne stated that Commission meeting will not be held next week, due to the Memorial Day holiday.

Road Items - Supervisor Nielsen
Supervisor Nielsen informed the Commission that Ron Johnson asked if it was ok to bid out smaller amount of weeds chemicals, several times during the year. The Commission was in agreement with this request.

Supervisor Nielsen stated that Stan Keller has contacted him, and he is no longer interested in being on the Weed Board. The Commission will replace Mr. Keller with a Farmer/Rancher from the community.

Discussion of Road #115 Mt. Home Area
Supervisor Nielsen has received a bid from Buxton & Associates, Inc. for the following Engineering Services in the amount of $3,670.00:  B&A proposes to provide a thorough analysis of the following alternatives:

  1. Reconstruction of the existing alignment to a maximum grade of 8%.

  2. Complete re-alignment of the road with a maximum grade of 8%.

  3. Adequacy of the existing conditions, or do nothing alternative.
    The analysis will provide Duchesne County with the following information:  1.   Engineers cost estimate of each alternative; 2.  Determine extents of impact to adjacent property owners, due to construction of each alternative; 3.  Determine the existing roadway grade and compare to generally excepted roadway design standards.

Motion: Commissioner Ross motioned to have Buxton & Associates do the work as they have outlined and have it done within thirty days of them accepting the agreement, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Commissioner Kappen informed Supervisor Nielsen that he has received prices from Burdick Paving, and Ned B Mitchell for their laydown machines.

Burdick Paving  $180.00/hour for two workers & equipment
Mitchell excavating  $145.00/hour for two workers & equipment

It would cost the County $114.00 per hour owning a laydown machine and two workers to run it.

Commission Kappen would like to have it on the meeting agenda for discussion on June 5th.

Commissioner Ross informed Supervisor Nielsen that the Commission has received a copy of the following letter sent by the forest service to the land owner on the North Fork River, Cripple Creek area:

Dear Landowners,

The Forest Service and Duchesne County are continuing our joint efforts to upgrade the North Fork Road through the Cripple Creek area. At a public meeting with Cripple Creek Landowners in Salt Lake City on 4/18/00 the Forest Service committed to compete road relocation as it may effect your property.

I'm pleased to inform you that the survey has been completed and the road location through Cripple Creek has been staked. As you review the layout you will note that in all but one case, which actually lies within National Forest System lands, our engineer was able to design the needed road width within the current fenced right of way.

To enable us to proceed with this project, it is critical that the next steps, outlines below be accomplished within a 15-30 day period.

  1. Landowners review the road location and determine any "on the ground" concerns.

  2. Duchesne County review the and location and proposed standards and if agreeable, proceed with a public road proposal hearing process.

  3. Agreement on right of way location between the Forest Service, Duchesne County and the private landowner at the site where the road improvements ties into the existing pave road.

I have already initiated discussions to resolve item #. However, I need landowners input for item #1 as soon as possible so that the Forest Service and Duchesne County can coordinate our efforts to resolve this road issue.

Please notify me by letter, phone or leave a message at the Duchesne Ranger District Office. I will continue to keep you informed of our progress.

The Commission asked Supervisor Nielsen to meet with the Forest Service and check the specs on the road and make sure it meets County Road requirements.

Discussion of Tar Sands
Commissioner Ross stated his concern about discussing the tar sands agreement with Esther Fausett in an open meeting. Commissioner Thayne said the only thing that needed to be discussed today was the payment Mrs. Fausett. An executive session will be on the 5th of June to finalize the Tar Sands Agreement.

Supervisor Nielsen said that next week they would start hauling tar sands and asked the Commission if they could work 2 eleven-hour shifts and 1 ten-hour shift making a 32-hour workweek, because of the Memorial Day Holiday. Commissioner Ross questioned if the drivers would be getting tired driving for eleven hours. Supervisor Nielsen stated that it is only one hour longer than they usually work. Under Federal Statute 12 hours is maximum. The Commission agreed to this request.

Commissioner Ross stated that the Commission and others will be taking a road tour and holding meetings with the Utah Department of Transportation Commission on May 24 & 25. Road issues that will be discussed:
  1.    Utah Highway 87 - Duchesne North
  2.    US 40 Ioka junction
  3.    Myton stop sign.
  4.    Pleasant Valley interchange
  5.    Bridgeland junction
  6.    Bridgeland tressell bridge
  7.    Arcadia Road
  8.    Red Creek interchange
  9.    Fruitland Store passing lane
10.    Roosevelt Jr. High junction
11.    Bluebell extension East
12.    L & L corner US 40 East

Edith Larsen who was present suggested to the Commission that they look at US 40 in front of Roger Hickens home, there are problems there when the school bus drops kids off and traffic backs up. The Commission thanked her for her suggestion.

Letter from Mark Walsh dated May 16, 2000 was presented on the procedures on quiet title action on RS2477 roads. This letter is on file in Clerks office.

Auditor's Office - Vouchers - Department Head Time Sheets - Tax Adjustments - Personnel Issues

Clerk/Auditor Diane Freston presented voucher #68601 to #68649 totaling $81,926.13 for approval.  Motion: Commissioner Kappen motioned to approve the vouchers Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Seize & Sale of Personal Property - Treasurer
Colene Nelson County Treasurer presented the following list of companies that have not paid their personal property tax.

Motion: Commissioner Ross motioned to have Roland Uresk Deputy County Attorney, communicate with these companies and try to collect the property tax and to report back in the June 12th meeting, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Teleconference with Bob & Ilene Donahue the Mineral Rights on Surplus Property sold to them at Tax Sale  This item has already been taken care of and will not be discussed.

Wellness Committee Presentation, Discussion & Expenditure
Judy Mutton Personnel Director and the Commission discussed the Wellness program for County employees. Judy has discussed with the other member of the Wellness Committee and they feel it is a good program. The County in conjunction with Uintah Basin Medical Center and IHC insurance will provide Health Screening for all County employees.

Motion: Commissioner Ross motioned to approve the Wellness program for County employees, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioner Voting Aye.

Discussion on Utility Billing - Avatar Corporation
This item will be discussed at a later date.

Final Plat Approval - Mt Home Heights - Wilbur Hammond
Teresa Nielsen, secretary Planning and Community Development and Wilbur Hammond were present to discuss Mt Home Heights. Teresa informed the Commission that Mr. Hammond has met all the requirements by the Planning and Zoning Commission, and Supervisor Nielsen has signed off the roads. The Planning and Zoning Commission approved the final plat.

Motion: Commissioner Kappen motioned to approve the Final Plat for Mt Home Heights, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.
