MINUTES FOR REGULAR COMMISSION MEETING HELD ON MAY 15, 2000 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R Thayne, Commissioner F Ted Kappen, and Commissioner Larry S Ross.

Others Present:  Diane Freston County Clerk/Auditor, Shelley Brennan Executive Secretary, Clerk/Auditor's Office Taking Minutes.  Beverly Park, Regina Burnhurst, Roger Holfeltz.

Minutes:  Minutes for May 8, 2000 were read.  Motion:  Commissioner Kappen motioned to approve the minutes with corrections, Commissioner Ross second, the motion carried.   Roll Call Vote:  All Commissioners Aye.

Road Issues – Supervisor Nielsen
Supervisor Nielsen reported that he again talked to Greg Searle with the Utah Department of Transportation, Greg informed him that the funds for the Arcadia Road Project are ear marked and cannot be lost or used for anything else. 

Supervisor Nielsen informed the commission that he met with the people in Pinion Ridge/Pinion Retreat area.  And the road department will start work on the roads next week.

The Commission and Supervisor Nielsen discussed RS2477 roads on Bureau of Land Management.  Supervisor Nielsen has received the overhead shots from NRCS, he has put them in conference room #1 and would like the Commission to look at them this afternoon about 3:00 p.m.

Commissioner Kappen questioned if we ever received the D road maps from the State.  Supervisor Nielsen has a D Road map.  Supervisor Nielsen would like to compare the D road map and the other RS2477 maps with the overhead map.  

Commissioner Thayne would like to discuss the issue of the new employee the road department needs.  Supervisor Nielsen stated that last year after the two summer workers wrecked the weed department truck, they sent Matt Christensen over to help Ron.  Matt has originally been hired for the weed department, before he transferred to the road department.  Supervisor Nielsen would like to leave Matt with the weed department at the same hourly wage and hire someone new to replace him at the road department.  Supervisor Nielsen stated that he will be able to keep both Matt and Ron busy all winter long.  The Commission was in agreement with this. 

Motion:  Commissioner Ross motioned to agree to the proposal that Supervisor Nielsen made, Commissioner Kappen second, motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Commissioner Thayne stated that Phillip Huff with the Utah Department of Transportation has contacted him.  Mr. Huff would like to discuss the Red Creek Road problems.  A meeting will be set up. 

Commissioner Ross stated that the boulders that have been placed on the side of the road where the Kiosk for the Back Country By-Ways project will go are a safety hazard.  Ken Richens told Supervisor Nielsen that they will be moved. 

Commissioner Ross asked Supervisor Nielsen for all the information he has relative the State transfer of roads to the County.  Supervisor Nielsen and Shelley will gather what information they have. 
Commissioner Ross stated the Randy Crozier, General Manager of the Duchesne County Water Conservancy District has contacted him again, and asked if we were willing to put gravel back on the road after they have put the pipeline in on the Red Creek Irrigation Company.  It would cost the County approximately $12,000.00 a mile.   Randy wants to get the contract going in next few months.  We need to make sure that the road is put back to spec. Commissioner Ross feels that we should treat them like a town or City and help them out a little.   Supervisor Nielsen is not sure that we have enough funding to buy the gravel, but the trucking will not be a problem.  It would be more economic to buy the gravel from Young’s than it would be to haul it from the nearest County gravel site.  Supervisor Nielsen will check the prices again and get back to us.  

Commissioner Ross stated that Mr. & Mrs. Roberts came in to visit him last week and said that the logging trucks have done some damage to the roads that County fixed last year in Argyle Canyon.  The logging company pushed a lot of gravel off the road when they were pushing snow.  Art Northemrup has told Doug that they will recover the gravel.

Motion:  Commissioner Ross motioned to approve the tax adjustments, Commissioner Kappen second, the motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Leann Stewart Deputy Clerk/Auditor presented Department head timesheets for signature.

Diane Freston Clerk/Auditor presented voucher #68488 to #68600 totaling $204,864.91 for approval. 

Motion:  Commissioner Kappen motioned to approve the vouchers, Commissioner Ross second, the motion carried.   Roll Call Vote:  All Commissioners Voting Aye.

Discussion of Quiet Title Action on RS2477 Roads
Clayton Chidester Director of Planning and Community Development was present to report to the Commission what the Public Lands Use Committee opinion of this matter is.  Clayton said that the Public Lands Use Committee is in favor of participating in the lawsuit with the State. 

Motion:  Commissioner Ross motioned that due the vital issues that will be effected, we join the State in the Quiet Title Action of RS2477 Roads, Commissioner Kappen second, the motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Discussion of Contract for Maintenance of Fair Grounds
The Commission reviewed the options they have for Maintenance at the Fair Grounds.  The Commission feels it is in the best interest of the County to have one person maintain the horse stalls, the arena, the bucking chute corals, and maintain and rent the horse stalls.  The Commission would like to contract with Jerry Lisonbee for $1,800.00 a year. 

Motion:  Commissioner Kappen motioned to contract with Jerry Lisonbee to maintain the horse stalls, the arena, the bucking chute corals, and maintain and rent the horse stalls, Commissioner Ross second, the motion carried.    Roll Call Vote:  All Commissioners Voting Aye.

Discussion of the Cliff Mickelson Building owned by Duchesne County  Neal Potter Manager of Building and Grounds was present to discuss the Cliff Mickelson Building.  The Commission and Neal agree that the County has no use for the Building except for three weeks during the County Fair. 

Motion:  Commissioner Ross motioned to offer the building “as is” to Duchesne City if they do not want the building then we will put it on the market and sell it, Commissioner Kappen second, the motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

The Commission asked that Shelley prepare a letter to Duchesne City.  

Concerns with Gateway & Crossroads Senior Center Building Rentals  Neal Potter Manager of Building and Grounds and Christie Ivie Gateway Senior Center Director were present to discuss the problems at the senior center.  Someone is having to be paid to watch the center when ever it is being rented, due to people not taking care of the building.  People have been moving the seniors stuff around and ruining it, kids run up and down the halls and make messes, kids are ruining the flower beds and making messes with dirt and gravel.  Christie would like to either raise the rental price or not rent it out anymore, now we charge $200.00 deposit, and $50.00 dollar rental fee.  A lot of times damage to table and chairs is not noticed until weeks later so the deposit doesn’t really do much. 

Motion:  Commissioner Ross motioned to increase the price of the deposit to $250.00 and the rental fee to $100.00 plus $7.00 per hour for the cost of wages for a County authorized employee to watch the center, Commissioner Kappen second, the motion carried.  Roll Call Vote:  All Commissioner Voting Aye.

Consideration of Resolution 00-11 A Resolution Adopting Section 22 of the Duchesne County Policy and Procedures Manual - Communications Systems Usage  The Commission reviewed Resolution 00-11.

RESOLUTION NO.  00-11
A RESOLUTION ADOPTING A POLICY REGARDING EQUIPMENT AND COMMUNICATION SYSTEMS USAGE

WHEREAS Duchesne County deems it appropriate to set forth a policy setting forth guidelines for use of County equipment and the County communication system; and,

WHEREAS Duchesne County promotes the use of the County equipment and communications systems for the benefit of the County and its employees; and,

WHEREAS Duchesne County anticipates the use of the equipment and communications system for the general benefit of the community; and,

WHEREAS Duchesne County desires to prevent abuse within the use of the equipment and communications systems and is creating this policy as guidelines to avoid such abuse,

BE IT HEREBY  RESOLVED by the Board of County Commissioners for Duchesne County that

1.       The policy for the usage of County equipment and the County communications systems heretofore Section 22 of the Policy and Procedures Handbook shall be amended to read as follows:

SECTION 22 - COMMUNICATION SYSTEMS USAGE
22.1 Phone Usage.  Every employee shall limit personal calls made from or received on Duchesne County equipment. Unnecessary personal telephone calls during working hours are disruptive to productivity.  All personal calls shall be brief.  Employees shall practice discretion when making personal phone calls and may be required to reimburse Duchesne County for any charges resulting from their personal use of the telephone.

22.2 Personal Use of Duchesne County Equipment and Facilities.  Equipment such as computers, printers, phones, copy machines, video machines, and other devices are provided to the employees for legitimate county business-related uses and are the property of Duchesne County.  Personal use of county equipment for personal or community service projects is allowed in accordance within the following rules and regulations.

22.2.a Personal use of County equipment and facilities is allowed only with the supervisor or department head=s permission.  The department head or supervisor shall monitor personal use of county equipment for abuse of the privilege. 

22.2.b The use of County equipment or resources for projects which result in personal gain, wages, or pay is prohibited, and shall result in disciplinary action. Disciplinary action may be in addition to any appropriate criminal charges.

22.2.c Personal use of County equipment or facilities shall not interfere with the employee=s regular work assignments or with another employee’s workload.22.2.d Employees shall not have any expectation of privacy in any communication or material obtained through the use of county equipment.  The County reserves the right to monitor the use of any equipment by employees.  Rude, inappropriate or offensive communications or uses with illegal, racial, sexual, religious or other harassing content are strictly prohibited.  Employees shall refrain from using County equipment for personal use that they consider confidential and private.

22.3 The Internet and Outside Software.

22.3.a     All outside software, including screen savers, messengers, games, etc., must be pre-approved by the department head or supervisor and the Director of Information Systems to avoid unnecessary overloading of hardware and to insure virus free software.   Verification that outside software is virus free shall be made before any outside software can be installed on any County computer.  Use of outside software on County computers is a privilege and not a right and use of such software shall be in accordance with these rules and shall not result in the overloading of the County computers and systems. The County does not condone the use of unlicensed software. Any employee found to have unauthorized software on their computer shall face disciplinary action, up to and including possible termination.

22.3.b The Internet is provided to selected departments and employees for legitimate county business-related uses.  Use of the Internet is a privilege and not a right and shall be at the discretion of the department head or supervisor.

22.3.c Use of the Internet shall not interfere with the employee=s regular work assignments or with another employees workload.

22.3.d Use of the Internet to access illegal activities, ie. child pornography, gambling, etc.  is strictly prohibited and any employee using the County Internet and/or County equipment in these activities shall be subject to immediate termination.

22.3.e Use of the Internet to intentionally access Adult sites is prohibited and shall result in disciplinary action against those employees engaged in such activities.  Adult site is any site which offers material of an sexual nature, ie.  video or still pictures of sexual activity or graphic depictions of nudity intended to be sexual in nature. 

22.3.f Employees shall not have any expectation of privacy in any communication or material obtained through the use of the County Internet connection.  The County reserves the right to monitor the use of the County Internet connection by employees.  Employees shall refrain from using the County Internet connection for personal use that they consider confidential and private.

2.       This policy shall be effective immediately upon passage.

Motion:  Commissioner Ross motioned to adopt Resolution 00-11 A Resolution Adopting Section 22 of the Duchesne County Policy and Procedures Manual – Communications Systems Usage, Commissioner Kappen second, the motion carried.  Roll Call Vote:  All Commissioners Voting Aye.

Setting Dates for Community Information Meetings
The Commission would like to set dates to have Community Information Meetings.  These meetings will be to receive public comments on County issues and everyone will be encouraged and welcome to attend.  The Commission would like to set dates for Tabiona and Roosevelt to see how things will go.  Dates for the other Cities will be set at a later date.

Roosevelt:  June 14th 7:00 p.m. @ the Crossroads Center
