MINUTES FOR REGULAR COMMISSION MEETING HELD ON MAY 1, 2000 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R Thayne, Commissioner F Ted Kappen, and Commissioner Larry S Ross.

Others Present:  Roland Uresk Deputy County Attorney, Diane Freston County Clerk/Auditor, Shelley Brennan Executive Secretary, Clerk/Auditor's Office Taking Minutes. David Moore, and David Howell with the Bureau of Land Management, Randy Crozier with Duchesne County Water Conservancy District, Sue Coleman, Sharon Olsen, Alma Richens, Raymond Hardman, John Roberts, Darrell Casper, Dennis Jones Mayor of Tabiona Town.

Minutes: Minutes for April 24, 2000 were read.  Motion: Commissioner Kappen motioned to approve the minutes with corrections, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioner Aye.

Road Issues - Supervisor Nielsen
Supervisor Nielsen informed the Commission that the reclamation of the roads and the core drilling sites at the tar sands pit has been completed.

Supervisor Nielsen presented payment request #11 in the amount of $26,899.88 and #12 in the amount of $2,896.10 for Engineer Service Agreement #BRO-LC13(2), Contract # 99-8204 Strawberry River Bridge Project.

Motion: Commissioner Ross motioned to approve the payment request from Horrocks Engineers, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Commissioner Ross asked Supervisor Nielsen for a report on bridges 6 & 7. Supervisor Nielsen stated that as far as he knows everything is going as they planned, he would call Rex Harrison with Horrocks and get a report from him.

Commissioner Kappen asked about the Arcadia Road Project. Supervisor Nielsen stated that he is not sure of the project's status; he will contact Greg Searle with UDOT and find out how things are going.

Discussion of Information Panels - Dave Moore
David Moore and David Howell with Bureau of Land Management, Vernal Office was present to brief the Commission on the progress of the "Back Country Byways" project. The project begins a ¼ mile south on County Road #33 off of Highway 40. They showed the Commission a picture of the Kiosk that will be placed at the roadside. The kiosk shows maps and gives some history of the area. The area where the Kiosk will be placed is already paved. The Commission said that would be fine and asked if they would need help installing the Kiosk? They said that they will be installing the Kiosk themselves and may require some assistance, they will let us know. The Commission thanked them for their time and efforts on this project. Bert Jenson, a historian of the Nine Mile Road, initiated the project. The Nine Mile Road is one of the first freight routes to the basin.

Discussion of Water Conservancy District - John Roberts Farm Creek Canal Company   John Roberts with Farm Creek Canal Company was present to discuss the Duchesne County Water Conservancy District. John and others from the West end of the County feel that they are not adequately represented on the Districts Board. They would like to know how the Commission appoints and what the requirements are. The Commission informed him that at the time the terms are up the County advertises for interested residents to submit resumes. When we advertise for the West end of the County, if the Canal Companies would like submit names for consideration, the Commission will gladly accept them. Commissioner Ross asked Randy Crozier, District Manager, if he would provide John with the dates that the seats for that area will expire. Randy said he would.

Motion: Commissioner Ross motioned to approve the list of Election Judges as presented by the Clerk/Auditors office, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Approval for Fruitland and Tabiona doing Election by Mail
Deputy Clerk/Auditor Lee Woods has conducted a phone survey of the Fruitland and Tabiona Area to get opinions on the Election by Mail. In Fruitland out of 24 people 22 were in favor of the Election by Mail and 2 were opposed. In Tabiona Lee had a harder time with the survey; most of the people she called were not home. Out of 11 people 7 were in favor of Election by Mail and 4 opposed.

The Commission feels that we did not get a good count for the Tabiona area. Commissioner Ross suggested that we continue with poll booth voting in Fruitland & Tabiona precincts and conduct a survey at the next election.

Motion: Commissioner Ross motioned to take a vote of the Tabiona and Fruitland areas at the time of this years election to see if the citizens would prefer an Election by Mail or by Poll Booth, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Lee Woods Deputy Clerk/Auditor presented a request for transfer of vacation hours. Her husband is a correction officer at the jail, he is donating 40 hours of his vacation to Lee. Lee has used up all of her vacation hours taking her kids to doctor appointments, or sport activities.

Motion: Commissioner Kappen motioned to transfer 40 hours of vacation from Elden Woods from his annual leave to Lee at her wage, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Mayor Town of Altamont - Travis Mitchell
Mayor Travis Mitchell was not present.    

Resolution 00-10 A RESOLUTION ADOPTING A POSITION OF UNITY AND COOPERATION BY DUCHESNE COUNTY WITH THE UTE INDIAN TRIBE IN RE: NAVAL OIL SHALE RESERVOIR NO. 2

RESOLUTION 00-10
A RESOLUTION ADOPTING A POSITION OF UNITY AND COOPERATION BY DUCHESNE COUNTY WITH THE UTE INDIAN TRIBE IN RE: NAVAL OIL SHALE
RESERVOIR NO. 2

WHEREAS, a portion of Duchesne County is within the exterior boundary of the Uintah and Ouray Reservation of the Ute Indian Tribe; and

WHEREAS, the Ute Indian Tribe and individual Ute Tribal members reside and own property interests in Duchesne County; and

WHEREAS, the Ute Indian Tribe and Duchesne County have acted in a spirit of cooperation with meaningful discussion in resolving their joint issues; and

WHEREAS, Duchesne County desires to further encourage a spirit of cooperation and meaningful communication with the Ute Indian Tribe, its leaders, and its members through mutual support of common goals, activities and resolution of joint issues; and

WHEREAS, a Bill has been introduced into Congress by Congressman Cannon to transfer ownership of lands called the Naval Oil Shale Reserve No. 2 located in the Uintah Basin to the Ute Indian Tribe; and

WHEREAS, Duchesne County desires to express its support for the transfer of the Naval Oil Shale No. 2 lands to the Ute Indian Tribe.

BE IT HEREBY RESOLVED by the Board of County Commissioners of Duchesne County that;

1.    The County Commission supports and encourages open and constructive dialog to resolve land issues that mutually benefit Tribal members and all residents of Duchesne County

2.    The County Commission hereby declares its continuing support for the transfer of the Naval Oil Shale Reserve No. 2 lands to the Ute Indian Tribe by the United States of America.       

3.    The County Commission hereby extends to the Ute Indian Tribe and its leaders its continuing governmental support for the successful completion of the transfer of the Naval Oil Shale Reserve No. 2 lands to the Ute Indian Tribe.

The Commission reviewed the Resolution.  Motion: Commission Ross motioned to adopt Resolution 00-10, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioner Voting Aye.

Discussion of Replacement for the Uintah Basin Medical Center Board  Commissioner Thayne stated that there will be vacancy on the Uintah Basin Medical Center Board, due to a member leaving to serve an LDS mission.  Motion: Commissioner Kappen motioned to advertise in the Uintah Basin Standard and accept resumes for two weeks. The Seat that needs to be filled will represent the Roosevelt area, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Discussion of Repairs at the Crossroads Senior Center
Karl Mott, Building Inspector was present to discuss the repairs that need to be made at the Crossroads Senior Center to bring us into compliance with American Disabilities Act. Karl has been in contract with Glenn Lloyd who was the Architect that the County used when building the center. Glenn has proposed the following hardware modifications: 

  • Doors #16 (Men's Restroom) and #17 (Women's Restrooms)

  • Remove (disable) latchset on door hardware

  • Leave lever hardware in fixed location of both interior & exterior sides

  • Fill strike in metal door jamb

  • Install new automatic door opener on door with electric push-pad mounted on wall surface on both inside and outside of doorway

  • Doors #14 (Library), #18 (Arts & Crafts) and #26 (Game Room)

  • Leave locking latch set as currently installed

  • Install new automatic magnetic hold-open device on door

  • Connect automatic hold-open device to existing smoke alarm system

Glenn told Karl he would be willing to purchase all the hardware if the County would install it or contract with someone to install it. Karl asked Glenn to send him specific list of the hardware he was willing to supply. Karl has not received that letter yet. Karl and Glen also discussed problems with wiring and conduit.

Motion: Commissioner Ross motioned that the Commission is agreeable to having the Architect supply the interior hardware, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Appointment of Risk Manager, and Safety Officer
Georg Adams Emergency Management Director and Judy Mutton Personnel Director were present. Judy stated, according to our insurance we need to appoint a Risk Manager and Safety Officer. If we implement this requirement it will help qualify us for reductions in our UACIM Insurance premiums.

Motion: Commissioner Kappen motioned to appoint Judy Mutton as Risk Manager, and Georg Adams as Safety Officer, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Discussion of Fire Protection with Cities
The Commission and Georg Adams Emergency Management Director reviewed the following letter:

Dear Mayor,

At the present time Duchesne City is providing fire protection services to County residents and lands outside the incorporated Duchesne City limits. Your fire department also assists in other areas as needed. For years we have been discussing acceptable remedies between the City and the County as to a fair and equitable formula for the reimbursement. The County has been dependant upon the City and is presently reimbursing the City by a pre-determined formula. We are proposing to revisit the issue by recommending on annual cash payment to the City for services performed outside the City, the City would provide all the services and the County would pay an annual set amount. The agreed upon amount would be paid in the first quarter of each year, putting in place the money for the years expenses.

If you and your Council are interested, the County will make a proposal for your consideration. Please give us your response by May 15, 2000.

Motion: Commissioner Ross motioned to send the above letter to Roosevelt, Myton, Duchesne, and Altamont cities, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Consideration of Proclamation for Health & Safety Week - Utah Highway Patrol   Clerk/Auditor Diane Freston presented the following proclamation on behalf of Lt. Stan Bench of the Utah Highway Patrol, who was unable to attend today's meeting:

Proclamation

Whereas, the health and well-being of Uintah Basin Citizens are the responsibility of each and every member of our community; and

Whereas, the Safety of our children is a significant concern for parents, community leaders, public safety officials, health care providers and government officials; and

Whereas, Preserving a healthy lifestyle is a community concern in that healthy citizens contribute more, and experience greater success in dealing with community issues and problems; and

Whereas, If started in childhood, property health, safety and environmental habits can be maintained and strengthened for a lifetime, producing a valued and well-respected member of society, ever enhancing our communities in the Uintah Basin; and

Whereas, The Uintah Basins Safety Awareness for Families Exposition, (UBSAFE) provides an excellent promotion of numerous safety and health displays to educate and encourage citizens to be more mindful of their health and environment.

NOW, THEREFORE, THE UNDERSIGNED, THE DUCHESNE COUNTY COMMISSION, STATE OF UTAH, do hereby proclaim the week of May 8th through May 13th as health and safety week.

Motion: Commissioner Kappen motioned to approve the Proclamation and make May 8th through May 13th 2000, health and safety week, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Auditor's Office - Vouchers - Department Head Time Sheets - Tax Adjustments - Personnel Issues

Clerk/Auditor Diane Freston presented voucher #68334 to #68382 totaling $21,119.32 for approval.  Motion: Commissioner Kappen motioned to approve the vouchers with corrections, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioners Voting Aye.

Discussion and Review of a Draft Copy of the Proposed Section 22 Policy and Procedures Manual Policy on Communications System Usage  Present for discussion:  Jack Wood & Michael Brennan Information Systems, Carolyn Madsen Recorder, Colene Nelsen Treasurer, Kris Bancroft Deputy Assessor, Karl Mott Building Inspector, Georg Adams Emergency Management Director, Neal Potter Building & Grounds Manager, Judy Mutton Personnel Director.

Proposed section 22 of the Policy and Procedures Manual set rules and guidelines for the use of County Equipment; telephones, computers, printers, copy machines, video machines, and use of the internet and other computer software not used by the County.

Those present reviewed, discussed and proposed changes for the Section 22 of the Policy and Procedures Manual draft.
