MINUTES FOR REGULAR COMMISSION MEETING HELD ON APRIL 10, 2000 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Chairman Commissioner Guy R Thayne, Commissioner F Ted Kappen, and Commissioner Larry S Ross.

Others Present:  Roland Uresk Deputy County Attorney, Diane Freston County Clerk/Auditor, Shelley Brennan Executive Secretary, Clerk/Auditor's Office Taking
Minutes. Sue Coleman, Sharon Olsen, Sue White, Darryl Mecham, Mark Monson, Lori Evans Director Duchesne County Library, Randall Thacker Regional Wildlife Biologist, Rick Hallmark Tri County Health Department.

Pledge of Allegiance

Minutes: Minutes for April 3, 2000 were read.  Motion: Commissioner Ross motioned to approve the minutes with corrections, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioner Aye.

Road Issues - Supervisor Nielsen
Supervisor Nielsen presented the following letter from The Town of Tabiona to the Commission:

Dear Commissioners:

The Town of Tabiona is in the process of installing a pressurized irrigation system throughout the town.

We would like to request the County Road Department to donate fill where we have had to cross the streets. We need approximately 400 yards of fill around approximately 16 truck & pup loads.

The Commission reviewed the letter and suggested that we also donate enough native tar sands to patch the streets.

Motion: Commissioner Ross motioned to approve the request for fill, up to 400 yards and to also donate enough native tar sands to patch the roads, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioner Aye.

Discussion of Free Dump Days at the Duchesne/Wasatch Bluebench Landfill  The Commission and Supervisor Nielsen discussed Free Dumps Days for this year. The week of May 8th through May13th was suggested. Free dump days are days that Duchesne County residents can take residential use garbage to the dump for free. This is for residential only no businesses are aloud to dump for free.

Motion: Commissioner Kappen motioned to approve May 8th through May 13th for Free Dump Days at the Duchesne/Wasatch Bluebench Landfill, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioner Aye.

6th Annual Con Amore Fishing Day - Mark Monson
Mark Monson presented the following Commissioner Brief on Con Amore Fishing Day:

The 6th Annual Con Amore Fishing Day will be May 18, 2000 in Rock Creek. We are here today because Commissioners Ross and Thayne expressed their interest in making a financial contribution to this marvelous event.

Con Amore Fishing Day is truly a community event. Our goal is to pair each student with an adult "buddy" for a fun-filled day of outdoor activities including fishing. Our objective is two fold:

(1)    Provide Con Amore students with a quality outdoor experience.

(2)    Provide community leaders an opportunity to spend a day with student who has special needs. The long-term effects are if a community leader becomes comfortable with a student, maybe they will hire them as an adult.

Request: Con Amore Fishing Day cost over $600. Expenses include 200 lunches for students and volunteers, bait and small prizes. In the past we have asked storeowners to provide materials and supplies at their cost. Hours of volunteer time are donated.

How does Duchesne County benefit?
1)    Students are Duchesne County residents.
2)    Many of the volunteers are Duchesne County residents.
3)    If successful on the long term, many of the Con Amore students will be given the opportunity to become gainfully employed.
4)    Fishing Day is a tremendous opportunity to highlight disabled recreation facilities in the County.
5)    The majority of financial contributions are spent in businesses located with the County.

The Commission feels that this is a worthy cause and benefit to the County. Commissioner Ross suggested that the County donate $600 dollars to help fund the Con Amore Fishing Day, Commissioner Thayne and Commissioner Kappen were in agreement. This will be on next weeks agenda for a motion.

Report on Library Projects and LSTA Grants - Lorie Evans
Lori was present to brief the Commission on the 1999 & 2000 LSTA Grants. The Library has been awarded the 2000 mini grant in the amount of $7,550 the Library will purchase three new computers with this money. She also informed the Commission that this week was National Library Week and she would like to thank the Commission for all their support.

The Commission thanked her for coming.

Auditor's Office - Vouchers - Department Head Time Sheets - Tax Adjustments - Personnel Issues   Judy Mutton Personnel Director was present to get a signature on a request for hire from the Jail for a new corrections officer. Commission Thayne signed the request.

State of Utah Division of Wildlife Resources Seasonal Road Closure - Randall Thacker   Randall Thacker was present to request that the County Commission allow the Division of Wildlife to do an Administrative winter road restriction on the Tabby Mountain Wildlife Management Area. Effective dates would be December 1 through April 15 annually. The benefits from this restriction would be:

1.    Reduce disturbance of wintering Deer and Elk.
2.    Reduce depredation by big game on neighboring private property.
3.    Reduce destruction of roads on DWR property.
4.    Increase law enforcement effectiveness - reduced poaching opportunity.
5.    Reduce the spread of noxious weeds on DWR property.

The Commission discussed the request with Randall and decided that they needed to set a date for a public hearing.

Motion: Commissioner Ross motioned to hold a public hearing on May 8th during a regularly scheduled Commission Meeting to receive public comment, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioner Aye.

Request for sign for the Gateway Senior Center Joyce Keysaw
Joyce Keysaw, Delores Walton, Shirley Gaylor were present to request help with placing a sign on main street with an arrow to help people find the center better. They would also like to have a sign out in front of the Administration Building. The Commission felt this would be a good idea. Commissioner Thayne will contact Supervisor Nielsen about the sign on Main Street. Commissioner Ross suggested that we add the Gateway Senior Center to the Marquee that is in front of the Administration Building.

Consideration of Moratorium on Dry Subdivisions
Roland Uresk Deputy County Attorney stated that during the last Planning & Zoning Commission meeting there was three or four preliminary plat approval. Commissioner Kappen stated that the last time he checked, there was 10,600 lots in Duchesne County there were dry and over 200 subdivisions that were dry.

The Commission feels that developers need to do business with the water districts or put in water tanks.

It is Roland's suggestion that a 120 day moratorium be put in place in order to give the Ordinance Revision Committee enough time to finish the ordinance they are working on setting the rules and guidelines for dry subdivision.

Motion: Commissioner Kappen motioned to approve the preparation of an Ordinance placing a 120-day moratorium on all dry subdivision in the County, Commissioner Ross second, the motion carried. Roll Call Vote: All Commissioner Aye.

Ordinance 00-160 will be on next week agenda for adoption.

Vouchers - Diane Freston Clerk/Auditor presented voucher #68064 to #68156 totaling $151,802.22 for approval.

Motion: Commission Ross motioned to approve the vouchers, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioner Aye.
