MINUTES FOR REGULAR COMMISSION MEETING HELD ON FEBUARY 7, 2000 BEGINNING AT 1:00 PM IN COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Guy R Thayne, Commissioner F Ted Kappen, and Commissioner Larry S Ross.

Others Present:  Diane Freston County Clerk/Auditor, Shelley Bench Executive Secretary, Clerk/Auditor's Office Taking Minutes.  Beverly Park, Regina Burnhurst, Frank Jeys, Neil Stevens, Dale Gines, Joel Gines.

 Prayer: Commissioner Ross

 Pledge of Allegiance

 Minutes:    Minutes for January 31, 2000 were read.

Motion:  Commissioner Kappen motion to approve the minutes with corrections, Commissioner Ross second, the motion carried.  

Roll Call Vote:    All Commissioners Aye

Road Issues - Supervisor Nielsen
Supervisor Nielsen discussed the Lake Borem  Right-of-Way with the Bureau of Indian Affairs, he is waiting to hear back from Norm Cambridge with approval of the Right-of-way. 

Planning & Community Development Department – Clayton ChidesterZoning Ordinance Change – Dale M. Gines, From Agricultural/Recreational 5 acres to Rural/Residential 1 acre.

Joel Gines and Dale Gines presented a zone change from agricultural/recreational,  5-acre zone to rural residential,  one-acre zone on parcel 00-005-1908, a 5.59-acre parcel.

Joel asks the Commissioners for a zone change for just a .59-acre lot, not what was presented to the Planning and Zoning Commission.  Clayton Chidester, the Planning Director said, that=s not what was presented to the Planning & Zoning Commission and this lot would not qualify anyway since the half acre zone requires both culinary water and sewer.

Commissioner Ross asked, what was presented to the Planning & Zoning Commission?  Clayton said, Dale Gines requested a zone change so Joel Gines can purchase the existing home on smaller acreage.  The remaining lots would not meet the current zoning, so the request is to change the zone for the entire parcel. 

Commissioner Ross asked if this existing well would be used to furnish water to any other homes, Joel said no. Clayton then responded that Dale has been informed that prior to a building permit being issued to the remaining lot, a Hanna Water connection would need to be purchased.  Dale has informed the Planning & Zoning Commission that he has purchased one water connection for this existing home, which is now on a well.  The water connection will be coming in the near future.  Commissioner Ross asked Clayton if this proposal meets the criteria for a zone change?  Clayton said yes, the Planning & Zoning Commission reviewed the criteria established in the zoning ordinance and makes a favorable recommendation. 

Motion:    Commissioner Ross motioned to approve the zone change for Dale Gines Commissioner Kappen second, the motion carried.  Roll Call Vote:    All Commissioner Voting Aye

Subdivision Approval Final Plat.  Neil Stevens, West Star Properties LLC Subdivision, Lots 1-3 Section 23 T3S R8W USB&M in the Fruitland Area.

            Neil Stevens and Clayton Chidester reviewed the plat with the Commission.

            Motion:   Commissioner Kappen motioned to approve the Final Plat for West Star Properties LLC, Commissioner Ross second, the motion carried.    Roll Call Vote:   All Commissioners Aye

Auditor's Office - Vouchers - Department Head Time Sheets - Tax Adjustments - Personnel Issues.

            Diane Freston Clerk/Auditor presented vouchers # 67226 to # 67539 totaling $148,260.39 for approval.

Motion:    Commissioner Ross motioned to approve the Vouchers with the exception of a voucher to Applied Concepts for a Radar Gun for the Sheriffs Office and three vouchers that need to be approved by Roland, Commissioner Kappen second, the motion carried.    Roll Call Vote:   All Commissioners Aye.

Tax Adjustments – Treasurer’s Office

Motion:    Commissioner Ross motioned to accept the Tax Adjustments presented by the Treasurer’s Office Commissioner Kappen second, the motion carried.  Roll Call Vote:   All Commissioner Voting Aye

Appointment to the Planning & Zoning Commission
The Commission received additional names today and would like to take two weeks for consideration.

Motion:    Commissioner Ross motioned to take two weeks to consider all the names received Commissioner Kappen second, the motion carried.  Roll Call Vote:    All Commissioner Voting Aye  

Review and Approval of Safety Manual for Duchesne County
SAFETY MANUAL FOR DUCHESNE COUNTY
Approved 1/31/2000

Motion:  Commissioner Ross motioned to adopt the Duchesne County Safety Manual for the County and all of its employees Commissioner Kappen second, the motion carried.   Roll Call Vote:    All Commissioner Voting Aye

Adjournment:   2:25 p.m.
