MINUTES FOR REGULAR COMMISSION MEETING HELD ON JANUARY 3, 2000 BEGINNING AT 1:00 P.M. IN THE COMMISSION BOARD ROOM
IN DUCHESNE, UTAH

Commissioners Present:  Commission Chairman Larry S Ross, Commissioner F Ted Kappen, and Commissioner Guy R Thayne.

Others Present:  Roland Uresk Deputy County Attorney, Diane Freston County Clerk/Auditor, Shelley Bench Executive Secretary, Clerk/Auditor's Office Taking Minutes. Sue Coleman, Roger Holfeltz, Jimmy Brotherson, Fred Tew.

Prayer: Commissioner Ross
Pledge of Allegiance

Minutes: Minutes for December 27, 1999 were read.
Motion: Commissioner Thayne motioned to approve the minutes with corrections, Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioner Aye.

Road Issues - Supervisor Nielsen
Supervisor Nielsen was present to update the Commission on the Antelope Road and other projects the Road Department is currently working on.

Auditor's Office - Vouchers - Department Head Time Sheets - Tax Adjustments - Personnel Issues.

Motion: Commissioner Thayne motioned to approve the tax adjustments presented by the Treasurer's Office Commissioner Kappen second, the motion carried. Roll Call Vote: All Commissioners Aye.

Christie Ivie Deputy Clerk/Auditor presented vouchers # 66769 to # 66830 totaling $ 186,195.73 for approval.  Motion: Commissioner Kappen motioned to approve the Vouchers, Commissioner Thayne second, the motion carried. Roll Call Vote: All Commissioners Aye.

Consideration of Resolution 00-01 A Resolution for Amending and Restating A Defined Contribution Plan.

WHEREAS, Duchesne County (Employer) employee a number of employees; and

WHEREAS, the Employer has employees rendering valuable services; and

WHEREAS, the employer previously has established a pension plan pursuant to the provisions of Section 401(a) of the Internal Revenue Code of 1986, as amended; and

WHEREAS, the Employer desires to continue to provide reasonable retirement security for its employees; and

WHEREAS, the Public Employees Benefit Services Corporation (PEBSCO) has been selected to provide record keeping and administrative services for the Pension Plan;

NOW, THEREFORE BE IT RESOLVED that the Employer Benefit Services Corporation (PEBSCO) to provide record keeping, employee education and other technical and administrative services relating to the plan; and

BE IT FURTHER RESOLVED that the Employer hereby authorizes an directs the County Commission to perform all acts and sign all documents necessary to put said plan into operation; and

BE IT FURTHER RESOLVED that Diane Freston, County Clerk/Auditor and Judy Mutton, Personnel Director are hereby appointed as Trustees and upon acceptance, by executing the Adoption Agreement of said plan, shall receive the necessary reports, notices, etc. from Public Employees Benefit Service Corporation (PEBSCO) and Nationwide Life Insurance Company.

I, Diane Freston, Clerk/Auditor of Duchesne County do hereby certify that the foregoing Resolution, proposed by Duchesne County was duly passed and adopted by the Commission of Duchesne County at a regular meeting thereof assembled this 3rd day of January, 2000, by the following vote:  Ayes:  3     Nays:  0

Motion: Commissioner Kapppen motioned to approve Resolution 00-01 Commissioner Thayne second, the motion carried. Roll Call Vote: All Commissioners Aye.

Discussion of Minutes - Roger Holfeltz
Mr. Holfeltz asked that he be put on today's agenda to express and to clarify his comments that were recorded in the September 27, 1999 Commission Minutes. Mr. Holfeltz referred to the US Constitution and the Utah State Constitution, then raised the question as to whether the County Procedures were/are Constitutional. Reference: Utah State Constitution, Article one, Section 18, Article one Section one, and Article one Section 27. United States Constitution, Ninth Amendment and 42 USC 1983 - 6.
